/BOOK 21 PAGE 430 <br />STATE OF NORTH CAROLINA::-);'! <br />`j FIRST AMENDMENT TO <br />ORIGINAL AGREEMENT <br />COUNTY OF LEE <br />This first amendment to the original agreement dated as of <br />200 ("First Amendment") between the County of Lee, North <br />Carolina, a body politic and corporate existing under the laws of the State of <br />North Carolina (the "County"), and the <br />Rural Fire Department, Inc., (the "Fire Department"); <br />WITIN ESSETH: <br />WHEREAS, the County and the Fire Department have heretofore entered <br />into an original agreement for the Fire Department to provide services in the <br />Fire District of Lee County (the "District"); and <br />WHEREAS, the Fire Department now also provides emergency medical <br />response services and the parties desire to amend their original agreement to <br />reflect such services. <br />NOW, THEREFORE, in consideration of the premises, the funds to be <br />paid, the mutual covenants and agreements herein contained and other good <br />and valuable consideration, the receipt and legal sufficiency of which are hereby <br />acknowledged by the parties hereto, the County and Fire Department hereby <br />agree that the original Agreement shall be amended as hereinafter set forth, to <br />wit: <br />SECTION 1: Confirming Amendments to the Original Agreement. <br />(a) All references in the original agreement to the providing of <br />services by the Fire Department are hereby amended to also <br />include "emergency medical response for and within the district". <br />(b) All references in the original agreement to the "Agreement" are <br />hereby amended to mean the Agreement as defined in this first <br />amendment. <br />SECTION 2: Ratification of Original Agreement. <br />Except as supplemented and amended hereby the original Agreement <br />in all respects is ratified and confirmed and the original Agreement as so <br />supplemented and amended hereby shall be read, taken and construed as <br />one and the same instrument. <br />
