Funderburke requested that Department of <br />Transportation officials be asked to talk with Mr. Gerrard Medlin concerning a <br />drainage problem on his land. Commissioner Clyde J. Rhyne stated he would see that <br />someone contacted Mr. Medlin. <br />The Chairman stated that the Lee County Parks and Recreation <br />Commission had discharged Mr. Jimmy Gaines from employment with them and <br />Mr. 17aines had appealed the decision to the Board. The Chairman then asked the <br />pleasure of the Board and Commissioner Jack D. Funderburke moved that the Board <br />go into executive session to consider the matter. Commissioner Lila P. Nielsen sec- <br />onded the motion and upon a vote it was unanimously adopted. Following the executive <br />session, the Clerk announced that the Board would conduct a hearing in the matter of Mr. <br />Gaines' discharge at its regular meeting on Monday, October 20, 1980, at 8:30 o'clock <br />p. M. <br />Mr. Martin Marks appeared before the Board on behalf of the Deep <br />River Volunteer Fire Department, Inc. , and requested that the Deep River Fire <br />District be increased in size to include an area extending out four miles from the <br />new fire station. After discussion and review by the Board,. Commissioner Gordon <br />A. Wicker moved that the boundary lines of the Deep River Fire District be approved <br />as set out in the map and description filed this date with the Board of Commissioners, <br />copies of which are attached to these minutes and by this reference made a part hereof. <br />Commissioner Jack D. Funderburke seconded the motion and upon a vote the motion <br />was unanimously adopted. The Chairman declared the motion duly adopted and directed <br />that certified extracts of this action be furnished to the appropriate agencies. <br />The Chairman announced that the Board had advertised a public <br />hearing on a proposed service district for fire protection in the Carolina Trace area. <br />Upon motion made, seconded, and duly adopted, the Board resolved to conduct such <br />hearing. The Chairman recognized Mr. Herb Fletcher who reviewed the efforts of <br />residents in the Carolina Trace Subdivision to obtain fire protection and outlined the <br />proposed plans to furnish such protection. The Chairman then recognized all interested <br />persons who wished to speak on the subject. The majority of, those who spoke were in <br />favor of establishment of a service district for fire protection. The only person who <br />spoke in opposition was not opposed to establishing a method to provide fire protection <br />but was opposed to establishment of a tax district without a vote. After hearing all <br />persons who wanted to speak and providing an opportunity and requesting anyone who <br />desired to speak to do so, the Board closed the public hearing upon motion of Comm- <br />issioner Gordon A. Wicker, seconded by Commissioner Lila P. Nielsen, which <br />motion was unanimously adopted upon a vote. The Chairman then asked the pleasure of <br />the Board with respect to the establishment of the service district for fire protection <br />at Carolina Trace. Commissioner Clyde J. Rhyne moved the adoption of the following <br />resolution: <br />RESOLUTION ESTABLISHING A SERVICE <br />DISTRICT FOR FIRE PROTECTION AT <br />CAROLINA TRACE <br />WHEREAS, The County Service District Act of <br />1973 (Article 16, Chapter 153A, North Carolina General <br />Statutes) authorizes a Board of Commissioners for a <br />County to define and establish service districts in order <br />to finance, provide, or maintain for the district fire pro- <br />tection services, facilities, and functions in addition to <br />or to a greater extent than those financed, provided, or <br />maintained for the entire County; and <br />
