WHEREAS, no further upset bids were received during the 10-day upset bid period and <br /> the original offer from Roy Campbell is the final and highest bid received. <br /> WHEREAS, the Lee County Board of Commissioners authorizes staff to advertise the <br /> initial offer in any higher, upsetting offer, subject to the upset bid procedure. <br /> NOW, THEREFORE, BE IT RESOLVED by the Lee County Board of Commissioners <br /> as follows: <br /> 1. The Lee County Board of Commissioners hereby accepts the offer of$26,738.50 from <br /> Roy Campbell. <br /> 2. The terms of the final sale are as follows: <br /> a. The buyer must pay with cash, cashier's check or certified check at the <br /> time of closing. <br /> b. The property is sold"as is"with no conditions placed on the bid. <br /> C. Title to the subject property shall be transferred to the buyer by a Non- <br /> warranty deed. <br /> d. Advertising fees are non-refundable once spent. <br /> e. The County Attorney does not perform title searches on the property and <br /> the Offeror can retain their own attorney to perform such title search. <br /> f. The buyer takes title subject to any easements, encumbrances and <br /> encroachments. <br /> 3. The County Manager, the Chair of the Board of Commissioners and all other <br /> appropriate County officials are authorized to execute the necessary instruments to <br /> effectuate the conveyance. <br /> Dated this the day of January, 202/ <br /> 'kirkD.
