Tvis Ordinance is adopted rurs,;eni to the authority conferred by Chapter o3, Article 4 of the General Statutes of ;North Carolina. It is hereby found that an airport i;vza d endangers the lives and property of users of the Sanford-Lee County Airport, and property or occuvants of land in is vicinity, and also the obstruction type, in effect reduces the size of the axes available for landing, takeoff, and uanuevering Of aircraft, thus tending to destroy or pair the utility of the Sanford-Lee County --_port and the public investment therein. Accordingl y, it is declared: (I) that the creation or establisr=ent of an _ruo-t hazard is a public nuisance and an in,;ury to the Eien z_3-,-ed by he Sanford-lee County __rport. (2) that it is necessary in the interest of the public ;health, public safety, and general welfare that the creation or establis7,-cnt of airport hazards be prevented; and (3) that the prevention of these haf-arda should be acco_plished to the extent legally pcssible,by the exe-cise of the police power without connensation. It is further .ecl. ed that both the __ze:tion of the Creation Or FSt2'Dlic]=:e^t of airport hazards and the elimination, removal, alteration, -itigation, or masking and lighting of existing airport hazards are _-ablic purposes for which the political subdivision may raise eypend public funds and acquire land or _nLerests in land.
