0 BOOK 22 i?~Gt 3$4 LEE COUNTY Committed Today for a Better Tomorrow ORDINANCE RESTRICTING THE USE OR SMOKING OF TOBACCO PRODUCTS IN COUNTY GOVERNMENT BUILDINGS OR VEHICLES WHEREAS, counties are granted broad police power authority to protect the health, safety, and welfare of county employees and the general public by North Carolina General Statute Section 153A-121 and authority to regulate the use of county property by North Carolina General Statute Section 153A-169; and WHEREAS, the Board of Commissioners has the authority to restrict smoking in county government buildings and public transportation vehicles used by the public pursuant to Article 23, Chapter 130A of the General Statutes of North Carolina; and WHEREAS, The Board of Commissioners of the County of Lee desires to protect the health of individuals working in or visiting county government buildings from the risks related to second hand smoke; NOW, THEREFORE, BE IT ORDAINED by the Board of Commissioners of the County of Lee as follows: Section 1: DEFINITIONS "Smoke" means the use or possession of a lighted cigarette, lighted cigar, lighted pipe, or any other lighted tobacco product. "Grounds" means the area located within fifty linear feet (50) of a building wherein one or more components of the Lee County Health Department or one or more components of the Lee County Department of Social Services are housed. `Tobacco Products' means any product that contains tobacco and is intended for human use or consumption. "County Government Building" means any building that is either owned by the county or is leased by the county as lessor, or is leased by the county, as lessee or any area in a building leased by the county as lessee and is occupied by the county. "Public Transportation Vehicles" means vehicles owned or leased by the county and used by the public.
