0 0 <br />BOOK 22 P"GE 282 <br />AN ORDINANCE AMENDING <br />THE LEE COUNTY UNIFIED DEVELOPMENT ORDINANCE <br />BE IT ORDAINED by the Board of Commissioners of Lee County, North Carolina that the <br />Unified Development Ordinance be, and it hereby is, amended as follows: <br />Section 1. Article 5. Supplemental Development Regulations be rewritten to include the <br />following new section: <br />5.37 Free-standing Ice Vending Units. <br />5.37.1 APPLICABILITY. <br />5.37.1.1 This section applies to any person, corporation or other organization desiring <br />to operate a free-standing ice vending unit within the zoning jurisdiction of the <br />County. Free-standing ice vending units or ''ice houses" shall be defined as self- <br />contained ice vending units that are typically placed in commercial zones for the <br />purpose of dispensing on-demand bags of ice. <br />5.37.2 LOCATION. <br />5.37.2.1 Free-standing ice vending units shall be permitted as set forth in Article 4, <br />Table 4.6-1 of this Ordinance. <br />5.37.3 STANDARDS. <br />5.37.3.1 Written approval from the property owner indicating permission to locate <br />vending unit on-site. <br />5.37.3.2 Vending units shall conform to the minimum setbacks as set forth in Table 4.7- <br />5 ofthis Ordinance. <br />5.37.3.3 Each vending unit shall be limited to the amount of wall signage as set forth in <br />Article 11, except however, in no case shall such vending unit he allowed to have more <br />than two (2) wall signs. <br />5.37.3.4 Vending units shall not be required any landscaping or vegetative screening <br />unless such unit is to be placed within 100 feet of a residentially zoned or developed <br />lot. If such unit is located within 100 feet, a class "C" buffer as set forth in Article 7 <br />of this Ordinance shall he required. <br />5.37.3.5 If a vending unit is to be placed within an existing parking lot serving an <br />existing business(es), then an analysis should he conducted to ensure that the loss of <br />any parking spaces shall not result in the loss of any required minimum parking for <br />the existing business(es).
