F' <br />.Jti11K 40 r,,`-- 98 <br />• The CLIENT will cause payments to be made to the CONSULTANT within thirty <br />(30) days of the date of the invoice. <br />E. Time of Performance: <br />The services of the CONSULTANT will begin upon delivery to the CONSULTANT <br />of an executed copy of this AGREEMENT and shall, absent of causes beyond <br />the control of the CONSULTANT, be completed within 90 calendar days <br />thereafter. <br />F. Termination of AGREEMENT for Convenience of CLIENT or for Cause: <br />The CLIENT may terminate this AGREEMENT at any time by giving written notice <br />to the CONSULTANT of such termination and specifying the effective date as <br />the date of receipt of said written notice. In that event, all finished or <br />unfinished documents and other materials shall, at the option of the CLIENT, <br />become its property. The performance of work covered by this AGREEMENT may <br />be terminated in accordance with Federal Procurement Regulations (FPR) <br />1-8.702. <br />• G. Other Provisions: <br />1. Nondiscrimination. <br />The CONSULTANT agrees not to discriminate by reason of age, race, religion, <br />color, sex, national origin, or handicap unrelated to the duties of <br />position, of applicants for employment or employees as to terms of <br />employment, promotion, demotion, or transfer, recruitment, layoff or <br />termination, compensation, selection for training, or participation in <br />recreational and educational activities. <br />2. Excusable Delays. <br />The CONSULTANT shall not be in default by reason of any failure in <br />performance of this AGREEMENT in accordance with its terms if such <br />failure arises out of causes beyond the control and without the fault <br />or negligence of the CONSULTANT. Such causes may include, but are not <br />not limited to, or restricted to, acts of God or of the public enemy, <br />acts of the government in either its sovereign or contractual capacity, <br />fires, floods, epidemics, quarantine restrictions, strikes, freight <br />embargoes, and unusually severe weather, but in every case the failure <br />to perform must be beyond the control and without the fault or negligence <br />of the CONSULTANT. <br />3. Findings Confidential. <br />• Any reports, data, or other information given to, prepared or assembled <br />by the CONSULTANT under the AGREEMENT shall, if requested by the CLIENT, <br />be kept confidential and shall not be published or made available to any <br />individual or organization by the CONSULTANT without prior approval of <br />the CLIENT. <br />4.
