aoo,~ 10 PACE 193 <br />a <br />(1) The exemption will not require a change in the <br />land use plan or the street plan. <br />(2) The exemption will not adversely affect the use <br />and disposition of adjoining parcels acquired or <br />to be acquired by the LPA. <br />(3) The owner of the property agrees to have com- <br />pleted the removal. or rehabilitation of all sub- <br />standard structures and to have eliminated any <br />non-conforming use on said property within 12 <br />months from the date of execution of any agree- <br />ment between the property owner and the LPA and <br />acquire such add:it.onal land as deemed necessary <br />by the LPA to conform to the setback, lot area <br />or similar provisions of the plan and sell any <br />portions of the property as deemed necessary by <br />the LPA for street ri.ghts-of-way or other purposes. <br />b. Exemptions shall be made conditional until the owner <br />has complied with all requirements of the contractual <br />agreement to be executed by and between the owner and <br />the LPA. <br />5. Conditions for Acquisition of Limited Interest Pro erties. <br />There may be instances in the CDP area where it may be <br />desirable for the LPA to acquire less than fee simple <br />title such as the removal of non-conforming structures, the <br />removal of a substandard structure from a parcel containing <br />a structure(s) capable of rehabilitation, and the like. <br />The LPA may desire to acquire limited interest under the <br />following conditions: The owner or owners of the affected <br />property must agree to sell the non-conforming or substan- <br />dard structure to the LPA at fair market value with fair <br />market value to be determined by two independent appraisals, <br />and in turn the value of the structure to be acquired by <br />the LPA to be determined by the difference between an <br />appraisal on the entire property and an appraisal on the <br />entire property less the structure to be acquired and re- <br />moved. The owner of the structure to be removed must grant <br />to the LPA permission to remove the structure. Additionally, <br />he must agree to conform to the controls of the plan. <br />No temporary project :improvements and facilities are con- <br />templated for the CDP area. <br />E. Land Disposition Supplement. <br />Cowtunity Development Program Land Use Map <br />Thoroughfares, other major streets and proposed land uses <br />are shown on the "Land Use Map Community Development Program <br />® Area". In conformity wi.th the Land Use Plan and the Thorough- <br />fare Plan for the City, the Redevelopment- Plan provides that <br />the CDP area will be developed for residential and residential- <br />related reuses. <br />-12- <br />
