g <br />Page 2 $O~JK D ?,,a 246 <br />Company, upon reasonable notice by the County, shall remove, re-lay, and <br />® relocate its equipment at its own expense. <br />Before installing underground or overhead services-under or over County <br />property.or right-of-way the Company shall enter into encroachment agreements <br />with the County and file plans and specifications before installation and as- <br />built drawings after installation. If--the County requests any services to be <br />removed from its property or rights-of-way because of conflict of encroachment <br />between the County and.the Company, the Company will remove the same, at its <br />own cost, within a reasonable time. <br />SECTION 4. The system shall be maintained and operated to render effi- <br />cient service and, in order to so do, the Company shall'have the right to <br />prescribe service rules and regulations for the conduct of its business not <br />inconsistent with the provisions of this ordinance; provided, however, that <br />the system will be operated so that there will be no interference with <br />television reception, radio reception, telephone communications or other <br />installations which are now or may hereafter be installed and in use by the <br />County or any person within the County. <br />® . SECTION.5. The rates for installation of equipment and regular sub- <br />scriber services shall be as set forth in Appendix A. <br />SECTION 6. No increase in rates charged for installation of equipment <br />and regular subscriber services as specified in Appendix A shall be made <br />effective except as authorized by the Board of Commissioners of the County <br />of Lee after an appropriate public proceedings affording due process. <br />Recognizing the pendency of court litigation and Congressional legis- <br />lation at the time of the passing of this ordinance which may impose copy- <br />right liability on all or a part of the cable television service rendered by <br />the Company in the County, and further recognizing the uncertainty and <br />jeopardy which such potential liability places upon the Company, should <br />such copyright liability be imposed by any court or by the Congress, the <br />Company shall have the right to increase its rates for regular subscriber <br />services in order to offset such copyright liability. Any increase in the <br />Company's rate schedule pursuant to this paragraph shall be limited to the <br />amount of the copyright liability imposed. Such increase shall not be subject <br />to the procedures specified in the preceding paragraph and shall become <br />S effective 30 days after notice of such increase is given to the Board of <br />Commissioners together with a certification that the increase is due solely <br />to the imposition of copyright liability and that the increase is limited <br />to an amount necessary to cover the amount of:the copyright liability. <br />
