~aa 609K V Pl,CE $5i. binding the Board of County Commissioners for the County of Lee other than current obligation(s) or contracts to be fully executed within the current fiscal year and all within the budget appropriations made by the Board of Commissioners for the County of Lee. SECTION 6. Such powers as are now provided by statute of the State of North Carolina or by the Resolution of the Board of Commissioners for the County of Lee relating to the development of recreation programs are hereby vested in the Parks & Recreation Commission to be exercised by it subject to all restrictions contained in such powers and resolutions. SECTION. 7. There is hereby established a Parks & Recreation Department for the purpose of administering and operating recreational programs in . conformance with policies, rules and regulations promulgated by the Lee County Parks & Recreation Commission. SECTION 8. Appointment of the Director of the Parks & Recreation Department . shall be made by the Lee County Manager upon recommendation of the Parks & Recreation Commission. In the event that the County Manager does not accept the recommendation, the Parks.& Recreation Commission shall make another recommendation. This procedure shall continue until a mutually acceptable candidate is found. Other Parks & Recreation personnel shall be appointed by the Lee County Manager in accordance with current personnel policies. The-Parks & Recreation ® Commission shall consult with and advise the Manager in these appointments. All personnel of the Parks & Recreation Department may be terminated by the County Manager in accordance with current personnel polices. The Parks & Recreation Commission-may consult with and advise the County Manager in these actions, :Sk&l SECTION 9. Funds appropriated by the Board of Commissioners for the County of Lee and budgeted to the Parks & Recreation Department shall be disbursed by the County Finance Officer ofLEE COUNTY upon vouchers issued by the County of Lee and within the budget appropriations made. -Funds received by the Parks & Recreation Department from souces other than budget appropriations shall be deposited by the Board of Commissioners for the County of Lee, except those funds not previously budgeted or received by gift, bequest or otherwise, shall be approved as additional budgeted funds and disbursed in accordance with the terms of such gift or bequest. If other gifts or bequests are received by the Parks & Recreation Department without specific terms, those funds may be used for non-recurring expenditures. Overall recreation revenues collected in excess of the annual projection may, with approval of the Board of Commissioners, be credited to the Parks & Recreation Department for Capital Equipment, or such revenues may, with Board of Commissioners approval, be transferred to a Capital Reserve Fund for recreation purposes. SECTION 10. The Parks & Recreation Commission and/or the Parks & Recreation De- ® partment shall made full and complete reports to the Board of Commissioners for the County of Lee at such times as may be requested and at such other times as to the Board of Commissioners for the County of Lee may seem proper. SECTION 11. All resolutions by the Board of Commissioners for the County of Lee in conflict herewith are hereby repealed. SECTION 12.
