The allowable costs of the project shall not include any costs determined <br />by the FAA to be ineligible for consideration as to allowability under the <br />Regulations. <br />4. Payment of the United States share of the allowable project costs will be <br />made pursuant to and in accordance with the provisions of the Regulations. <br />Final determination of the United States share will be based upon the - <br />final audit of the total amount of allowable project costs and settlement <br />will be made for any upward or downward adjustments to the Federal share <br />of costs. The grant closeout requirements will be in accordance with <br />the Regulations. <br />5. The sponsor shall operate and maintain the airport as provided in the <br />Application for Federal Assistance incorporated herein and specifically <br />covenants and agrees in accordance with its Assurance 20 in Part V of <br />said Application for Federal Assistance, and Section 30 of the Airport <br />and Airway Development Act, as amended, that in its operation and the <br />operation of all facilities thereof, neither it nor any person or <br />organization occupying space or facilities thereon will discriminate <br />against any person by reason of race, color, creed, national origin <br />or sex in the use of the facilities provided for the public on the <br />airport. <br />6. The FAA reserves the right to amend or withdraw this offer at any time <br />prior to its acceptance by the sponsor. <br />7. This offer shall expire and the United States shall not be obligated <br />to pay any part of the costs of the project unless this offer has been <br />accepted by the sponsor on or before September 30, 1981, <br />or such subsequent date as may be prescribed in writing by the FAA. <br />8. It is understood and agreed the sponsor will submit for FAA approval <br />a Minority Business Enterprise Program as required by 49 CFR Part 23 . <br />section 23.41(a) no later than 90 days after the date of this agreement <br />rather than prior to the grant as specified in 23.41(b). All other <br />requirements in Part 23 become effective as applicable upon execution <br />of this grant. <br />9. It is understood and agreed that if, during the life of the project, <br />FAA determines that the grant amount exceeds the expected needs of the <br />sponsor by $5,000 or 5Y,'of the grant amount, whichever is greater, the grant <br />amount can be reduced by letter from FAA to the sponsor advising of the <br />budget change. Upon issuance of the letter, the maximum obligation of <br />the United States under the grant is reduced to the specified amount. <br />FAA Form 5100-37 Page 3 (8-81) <br />
