t1eo;~ 10 zo <br />WHEREAS, this ordinance adoption has proceeded according to <br />law being properly presented and considered; NOW THEREFORE, <br />BE IT ORDAINED BY THE LEE COUNTY BOARD OF <br />COMMISSIONERS: <br />Section 1. Title: <br />This ordinance shall be known and may be cited as the Lee <br />County, North Carolina Hazardous Waste and Low-Level Radioactive Waste Manage- <br />ment Facility 180 Day Moratorium. <br />Section 2. Purpose: <br />The purpose of this ordinance is to establish a moratorium on <br />the location or operation of any waste management facility dealing with the storage, <br />treatment or disposal of hazardous or low-level radioactive waste within Lee <br />County for a maximum of 180 days from the adoption of this ordinance. <br />Section 3. Definitions: <br />A. "Person" is defined as any individual, corporation, partner- <br />ship, firm, association, trust, estate, public or private institution, group, agency <br />or other entity or any successor thereof. <br />B. "Hazardous Waste" has the same meaning as defined in G. S. <br />130- 166. 16(7). <br />C. "Low-Level Radioactive Waste" is defined as radioactive waste <br />not classified as high-level radioactive waste, spent nuclear fuel as defined by the <br />U. S. Nuclear Regulatory Commission, transuranic waste, or byproduct material <br />as defined in Section Ile (2) of the Atomic Energy Act of 1954, as amended. <br />
