The County will make the above named space available to the Club <br />M <br />d <br />F <br />i <br />on <br />ay- <br />r <br />day at the following times: 3:00-6:00 p.m. school days and 6:30 a.m- <br />6:00 p.m. non-school days and during the summer with some exceptions. <br />Exceptions are: one week in April for floor care maintenance, and 12 days in mid <br />October for the Annual Brush and Palette Club Art Show. Also Note: During <br />volleyball and basketball seasons, Lee County Parks & Recreation personnel will <br />access the Hales Center approximately 5:30 p.m. to set up for department <br />programs. Program participants will access the Hales Center at 6:00 p.m. <br />6. <br />Equipment. The County will make available to the Club the volleyball net and <br />standards when requested- The Club shall provide any other equipment. The <br />Club may place a Boys & Girls Club logo sign on the front fagade of the Bob E. <br />Hales Center not to exceed 2' X 2' in size and at the Club's expense. The sign <br />shall be placed using wall anchors so that the sign may be removed if and/or when <br />the Club ceases to operate from the facility. <br />7. <br />Coin's Obli ation. In addition to providing the space for the times <br />hereinbefore set out, the County will maintain the building and pay for all utilities <br />including gas, electric, water and sewer. <br />8. <br />Club's Obligation. Club will employ a unit director and two part-time <br />ro <br />ram <br />p <br />g <br />assistants and will continuously operate its program during the period covered by <br />this agreement. The purpose will be to provide a safe place with meaningful <br />structured activities exclusively for youth from Lee County- The Club's <br />employees shall by way of housekeeping following the conclusion of their daily <br />activities pick up any trash and dust mop the gym floor. The Club shall be <br />responsible to promptly report any problems, breakage, or deficiencies with the <br />facility to the Parks & Recreation Department. All other maintenance and <br />janitorial services will be provided by the County. <br />9. <br />Independent Contractor. Club understands that, in entering into this agreement <br />and providing recreational opportunities, Club is acting as an independent <br />contractor; neither Club nor its employees, volunteers, or other personnel shall be <br />deemed or construed to be employees of Lee County or of its Parks and <br />Recreation Department. The Club shall be solely responsible for payment of all <br />state and federal pay deductions for its employees. The selection, retention, <br />assignment, direction, and payment of all Club's employees, members, <br />volunteers, or other personnel shall be the Club's sole responsibility and the <br />County shall not exercise any control over the daily performance of duty by Club <br />employees, volunteers, or other personnel. <br />10. <br />Indemnity. Club shall indemnify and hold County harmless from and against <br />any and all loss, cost (including attorney's fees), damages, expense and liability <br />(including statutory liability and liability under workmen's compensation laws) in <br />connection with claims for damages as a result of injury or death of any person or <br />property damage to any property arising from any acts, errors, omissions, or <br />negligence of Club, or of any of its agents, contractors, servants, employees, <br />licensees, or volunteers. <br />11. <br />Insurance. Club shall provide insurance coverage as follows: a commercial <br />general liability policy, with liability limits of $1,000,000.00 and occurrence/ <br />$2,000,000.00 aggregate and shall provide County with a certificate of insurance <br />
