BOOK 22 rAGE 63 <br />AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP <br />OF LEE COUNTY, NORTH CAROLINA <br />WHEREAS, a request to amend the Official Zoning Map has been received from Timothy & Suzette <br />Sloan (Case #2008-0201) to rezone 20.38+- acres, (further identified as a portion of Tax Parcel 9673-73- <br />4288, Lee County Land Records Office) from the current Residential Agricultural (RA) district to a <br />conditional zoning district to be know as "Sloan Mountain Vineyards & Winery Conditional Zoning <br />District'. <br />WHEREAS, said request has been presented to the Lee County Planning Board, and <br />WHEREAS, the Lee County Board of Commissioners conducted a public hearing on February 18, 2008 <br />to receive citizen input on the requested zoning map amendment; and <br />WHEREAS, the Lee County Board of Commissioners approves the request to amend the Official Zoning <br />Map of Lee County, North Carolina; <br />NOW, THEREFORE, BE IT ORDAINED BY THE LEE COUNTY BOARD OF <br />COMMISSIONERS: <br />The Official Zoning Map is hereby amended to rezone 20.38+- acres, (further identified as a portion of <br />Tax Parcel 9673-73-4288, Lee County Land Records Office) from the current Residential Agricultural <br />(RA) district to "Sloan Mountain Vineyards & Winery Conditional Zoning District". In making this <br />decision, the Board of Commissioners finds that the request appears to be reasonable and in the public <br />interest based on the information/conditions as presented in the conditional zoning application. Exhibits <br />A, B, C are hereby attached and included as part of this Ordinance. <br />The Board of Commissioners also finds that because this request is a conditional zoning request that the <br />Sloan Mountain Vineyards & Winery Conditional Zoning District shall include the following conditions: <br />General Conditions: <br />The Sloan Mountain Vineyards and Winery Condition Zoning District shall be limited to uses included in <br />the conditional zoning application and narrative text (Exhibit A) and as shown on the site plan (Exhibit B) <br />as submitted and approved. Development that occurs within the "future expansion area" noted on the site <br />plan shall be subject to the same design conditions as included in this Ordinance and shall be approved by <br />the appropriate Lee County staff. <br />Land Uses Permitted: <br />Land uses within the Sloan Mountain Vineyards and Winery Conditional Zoning District shall include the <br />following uses: <br />• Vineyards and Winery <br />• Wine tasting <br />• Agri-tourism functions including but not limited to winery tours <br />• Wholesale and retail sales of wine and grape products and agricultural products <br />• Retail sale of winery-related promotional items including pottery <br />• Gift items and pre-packaged foods <br />• Outdoor picnic areas for winery-related activities <br />• Social gatherings for events such as weddings, receptions, banquets and music festivals <br />• Special events that will coincide with the Sanford Pottery Festival <br />• Restaurant and or Bistro <br />
