The policy is not intended to prevent businesses from utilizing the parks, however it creates a process so that Parks and Recreation is made aware of when business is being conducted on park property and to prevent the perception that the businesses are representing the Parks and Recreation department. The policy states that the use has to be for a recreation activity that is appropriate for the site. The Board would have to approve a request that is not affiliated with a recreational purpose. If a business operates without a permit, they will be shut down by staff. If anyone who has a current booking does not want to go through the permit process, they will be issued a full refund for cancellation of their reservation. Facility rental fees would still be applicable in accordance to the approved Lee County Government Fee Schedule. This new structure will aide parks staff in managing the use of parks and also requires a Certificate of Insurance. Park facilities are open for the benefit of the public, and are not intended to be used for private, for-profit enterprises. Under this policy, conducting or soliciting of any business, trade or occupation, including the sale of food, refreshments or merchandise, the taking of photographs and motion pictures for commercial use and providing classes or lessons at a charge to participants or for the purpose of promoting a commercial enterprise is prohibited unless a Commercial Use Permit application is approved by the Parks and Recreation Director.
