• Sale of land <br /> The remainder of Section 1.6.3 Types of Violations shall remain in effect. <br /> Section 3. Article 4 PENALTIES & REMEDIES of the Lee County Unified Development <br /> Ordinance pertaining to watershed conservation overlay districts, Section 4.14.5.1 GENERAL <br /> PENALTY; ENFORCEMENT; CONTINUING VIOLATIONS, shall be amended to remove <br /> criminal penalties for violations in accordance with S.L. 2021-138 and rewritten as follows: <br /> 4.14.5.1 GENERAL PENALTY; ENFORCEMENT; CONTINUING <br /> VIOLATIONS <br /> (a) Except as otherwise provided herein, no violation of this Ordinance shall <br /> constitute a misdemeanor. <br /> (b) Violations of this Ordinance shall subject the offender to a civil penalty upon <br /> the issuance of a citation for said violation as hereinafter provided. The civil penalty, if not <br /> paid to Lee County within fifteen days of the issuance of a citation, may be recovered by <br /> the County in a civil action in the nature of debt. Said civil penalties shall be in the amount <br /> of$100 for each violation and each day any single violation continues shall be a separate <br /> violation. <br /> The remainder of Article 4 PENALTIES &REMEDIES, Section 4.14.5.1 GENERAL PENALTY; <br /> ENFORCEMENT; CONTINUING VIOLATIONS shall remain in effect. <br /> Section 4. Article 13 GENERAL PROVISIONS of the Lee County Unified Development <br /> Ordinance pertaining to flood hazard area regulations, Section 13.3.8 PENALTIES FOR <br /> VIOLATION shall be amended to remove criminal penalties for violations in accordance with <br /> S.L. 2021-138 and rewritten as follows: <br /> Violation of the provisions of this ordinance or failure to comply with any of its <br /> requirements, including violation of conditions and safeguards established in connection <br /> with grants of variance or special exceptions, shall subject the offender to a civil penalty <br /> upon the issuance of a citation for said violation. Any person who violates this ordinance <br /> or fails to comply with any of its requirements shall,be fined not more than X8.00-$50.00. <br /> Each day such violation continues shall be considered a separate offense. Nothing herein <br /> contained shall prevent Lee County from taking such other lawful action as is necessary to <br /> prevent or remedy any violation. <br /> The remainder of Article 13 GENERAL PROVISIONS shall remain in effect. <br /> Section 5. Article 13.6.2 AND 13.6.9 of the Lee County Unified Development Ordinance <br /> pertaining to flood hazard area regulations and stop orders shall be amended to remove criminal <br /> penalties for violations in accordance with S.L. 2021-138 and rewritten as follows: <br /> 13.6.2 STOP ORDERS <br /> Whenever a building or part thereof is being constructed,reconstructed, altered or repaired <br /> in violation of this ordinance, the administrator may order the work to be immediately <br /> stopped. The stop order shall be in writing and directed to the person doing the work. The <br />
