of local government ordinances. By default, a violation of a county ordinance was <br /> punishable by a criminal penalty unless the ordinance stated otherwise. SB 300 <br /> requires punishment of the county ordinance only if an ordinance specifically allows for <br /> a criminal penalty. The amendment also lists specific offenses that local governments <br /> are prohibited from criminalizing and allows for a defense to the ordinance. County staff <br /> engaged Mac McCarley and Catherine Clodfelter to review the suggested changes to <br /> the ordinance and their recommendation to both the Lee County Code of Ordinances <br /> and the Unified Development Ordinance is included in the agenda. The County and <br /> Planning Board held a joint public hearing on the proposed changes to the UDO on April <br /> 18, 2022. No one spoke for or against the proposed changes.
