PUBLIC HEARINGS <br />IV.A Public hearing on amendments to the Lee County Code of Ordinances and the <br />Unified Development Ordinance <br />County Attorney Whitney Parrish provided a summary of amendments to the Lee <br />County Code of Ordinances and the Unified Development Ordinance. Senate Bill <br />300, S.L. 2021-138 amended NCGS 153A-123, which regulates the enforcement of <br />local government ordinances. Before the amendments went into effect, by default a <br />violation of a county ordinance specifically allows the penalty. The amendment also <br />lists specific offenses that local governments are prohibited from criminalizing and <br />allows for a defense to the ordinance. County staff engaged Attorneys Mac McCarley <br />and Catherine Clodfelter to review the changes to the ordinance and make <br />recommendations. The Board of Commissioners and Planning Board must hold a <br />public hearing on the proposed changes prior to adoption.
