Upon a vote, the results were as <br />follows: <br />Aye: Hayes, Oldham, Parks, Paschal, Reives, Shook, and Womack <br />Nay: None <br />The Chairman ruled the motion had been adopted unanimously. <br />The Board considered a building Restoration and Reuse Application for Atlantic Hydraulics. <br />County Manager John Crumpton presented to the Board a Resolution and letter in reference to the NC <br />Building Restoration and Reuse Grants Program through the NC Rural Center. Mr. Crumpton asked <br />the Board to consider and approve a resolution authorizing the submittal of a Restoration and Reuse <br />Application to assist Atlantic Hydraulics, LLC in renovations to their 25,250 sq. ft. building located at <br />5225 Womack Road (Lee County Industrial Park). The proposed renovations will enable Atlantic <br />Hydraulics to expand its business and create eleven (11) new full -time positions. A 5% match will be <br />required that will be paid through the Lee County Economic Development Corporation. After <br />discussion, Commissioner Oldham moved to approve the Authorizing Resolution to the NC Building <br />Restoration and Reuse Grants Program and letter of support to the NC Rural Center, copies of which <br />are attached to these minutes and by this reference made a part hereof. County Manager John Crumpton discussed a licensing agreement with <br />ASCAP that will allow the County to play live or recorded versions of musical compositions copyrighted <br />by ASCAP artists. Copyrighted musical compositions are frequently played at events and activities <br />sponsored by the Parks and Recreation and Senior Citizens departments (aerobics, exercise, dance, <br />gymnastics classes, etc.), and as background music when callers to County offices are placed on hold <br />or when no recorded programming is being broadcast over Lee County Government TV. The American <br />Society of Composers ( ASCAP) has contacted the County and asserted such use of the music without <br />a license violates the federal copyright laws and subjects the County to severe financial penalties. After <br />research, it has been agreed that ASCAP's assertion is correct. ASCAP has agreement to waive all <br />past violations if the County agrees to enter into a blanket licensing agreement which will cost $637.00 <br />per year. After discussion, Commissioner Parks moved to approve a Licensing Agreement with <br />American Society of Composers, Authors and Publishers as presented, a copy of which is attached to <br />these minutes and by this reference made a part hereof. County Manager John Crumpton asked the Board to consider a <br />Resolution in reference to the financing of the property. The Board was also asked to adopt a <br />Resolution calling for a public hearing in connection with the financing of the purchase of real property. <br />6 <br />
