Consolidated Agreement FY23 Page 2 of 28 <br /> Children (CMARC) [formerly known as Care Coordination for Children (CC4C)]. These services <br /> may be funded by Medicaid, state or federal funding through Agreement Addenda, private funders, <br /> or local funds. <br /> a. Per the federal Child Abuse Prevention and Treatment Act (CAPTA)requirements, a notification <br /> to the county child welfare agency must occur upon identification of an infant as "substance- <br /> affected," as defined by NCDHHS, for the development of a Plan of Safe Care (POSC). The <br /> POSC requires that all substance-affected infants be referred by the local Child Welfare Agency <br /> to CMARC for care management and care coordination, regardless of insurance coverage. <br /> b. Medicaid requires that the LHD has the first right of refusal to provide CMHRP and CMARC <br /> services for FY21 —FY23. <br /> c. LHD shall use every resource including technical assistance from the regional consultants and <br /> State CMHRP and CMARC program leads to resolve issues to prevent care gaps and <br /> discontinuation of services. <br /> d. In the event that LHD determines it cannot directly provide CMHRP and/or CMARC, LHD <br /> shall: <br /> 1) Notify DPH and DCFW Directors in writing of LHD's intention to discontinue the service at <br /> least 180 calendar days in advance of discontinuing the provision of CMHRP and/or <br /> CMARC; <br /> 2) Cooperate with DPH in identifying another local health department that can provide these <br /> care management services; and <br /> 3) Provide a written plan to the DPH Director outlining the agreed-upon terms for the transition. <br /> Deviations from the above process will be handled on a case-by-case basis. <br /> 8. LHD shall notify the DPH and DCFW Directors if any of the following occurs: <br /> a. There is a legal name change to LHD. <br /> b. LHD becomes part of a consolidated human services agency, a district, or a public health <br /> authority. <br /> c. There is any other governance change. <br /> d. LHD is not subject to the NC Human Resources Act. <br /> Notification should be in writing within the next business day and provide a governance <br /> organizational chart and any relevant supporting documents reflecting the changes. <br /> 9. LHD shall retain financial and program records including electronic records in accordance with the <br /> North Carolina Department of Natural and Cultural Resources' Local Government Schedules <br /> records retention policy (https://archives.ncdcr.gov/government/local) and in accordance with the <br /> retention of those records as described in Section IV. Fiscal Control, Paragraph F. Records resulting <br /> from these services shall not be destroyed, purged, or disposed of except in accordance with the <br /> records retention policy and in accordance with State and federal law. The State's basic records <br /> retention policy requires all grant records to be retained for a minimum of five years or until all audit <br /> exceptions have been resolved, whichever is longer. If the contract is subject to federal policy and <br /> regulations, record retention may be longer than five years since records must be retained for a <br /> period of three years following submission of the final Federal Financial Status Report, if applicable, <br /> or three years following the submission of a revised final Federal Financial Status Report. Also, if <br /> any litigation, claim, negotiation, audit, disallowance action, or other action involving this <br /> Consolidated Agreement or any Agreement Addenda has been started before expiration of the five- <br /> year retention period described above, the records must be retained until completion of the action <br />
