LEE COUNTY <br />© O 0401 0QE Qe, 0 GD CA <br />Committed Today for a Better Tomorrow <br />RESOLUTION <br />APPOINTING GARRIS NEIL YARBOROUGH <br />AS INTERIM LEE COUNTY ATTORNEY <br />WHEREAS, North Carolina General Statute 153A -114 says "the board of commissioners shall <br />appoint a county attorney to serve at its pleasure and to be its legal advisor; and <br />WHEREAS, Lee County is now without a County Attorney due to the retirement of County <br />Attorney K. R. Hoyle and the recent passing of his replacement, W. Dale Talbert; and <br />WHEREAS, the Board of Commissioners desires to hire an interim County Attorney until the <br />search for a new permanent attorney can be completed; and <br />WHEREAS, the County Manager is recommending that the Board of Commissioners appoint <br />Garris Neil Yarborough and in his absence John H. Jackson of the same firm as the Interim <br />County Attorney; and <br />WHEREAS, Mr. Yarborough has served as the County Attorney for both Cumberland and <br />Hoke Counties and Mr. Jackson currently serves as Town and City Attorney for several <br />municipalities in North Carolina; and <br />WHEREAS, Mr. Yarborough and his firm have the necessary experience to serve as the <br />Interim Lee County Attorney; <br />NOW, THEREFORE, BE IT RESOLVED by the Lee County Board of Commissioners, that <br />Garris Neil Yarborough and John H. Jackson be appointed as the Interim County Attorney. <br />With this appointment, the Board gives Mr. Yarborough the full authority to act as its attorney <br />and to advise staff on legal matters. <br />BE IT FURTHER RESOLVED, said appointment is to be effective as of July 30, 2012. <br />Adopted this 20th day of August 2012. <br />ATTEST: <br />Linda A.
