not in default under the terms hereof, shall remove from the Premises all Tenant's <br /> personal property in order that the Landlord can repossess the Premises on the day <br /> this Lease or any extension hereof expires or is sooner terminated. Any removal <br /> of Tenant's property by Tenant shall be accomplished in a manner which will <br /> minimize any damage or injury to the Premises, and any such damage or injury <br /> shall be forthwith repaired by Tenant at its sole cost and expense. <br /> 3. RENT. <br /> a. Tenant shall pay to the Landlord as base rent, without notice or demand and <br /> without abatement deduction or setoff, except as elsewhere provided herein, the <br /> equal monthly installments of$5,186.00 on the first day of each and every <br /> calendar month during the term of this Lease. <br /> b. No payment by Tenant or receipt by Landlord of a lesser amount than the monthly <br /> payment in this Lease shall be considered anything other than a payment on <br /> account of the earliest rent due, nor shall any endorsement or statement on any <br /> check or any letter accompanying any check or payment as rent be deemed in <br /> accord and satisfaction. Landlord may accept such payment without prejudice to <br /> its right to recover the balance of the rent and to pursue any other remedy <br /> provided for in this Lease, or otherwise available at law or in equity. <br /> c. If any rent or other payment under this Lease is not paid when due, it shall bear an <br /> interest rate of ten percent (10%)per annum until paid, and in addition, the rental <br /> payment shall be subject to a two-hundred dollar($200.00) late service charge per <br /> month if not paid on or before the tenth (10th) day of each month. However, this <br /> provision shall not relieve Tenant from any default. <br /> e. If applicable in the jurisdiction where the premises are situated, Tenant shall pay <br /> and be liable for all rental, sales and use taxes or similar taxes, if any levied or <br /> imposed by any city, state, county or other governmental body having authority, <br /> such payments to be in addition to all other payments required to be paid to <br /> Landlord by Tenant under the terms of this Lease. Any such payment shall be <br /> paid concurrently with the payment of the Rent upon which such tax is based. <br /> 4. ADDITIONAL RENT. All personal property taxes, charges, costs and expense that <br /> Tenant assumes or agrees to pay hereunder, together with all interest and penalties that <br /> may accrue thereon in the event of failure of Tenant to pay those items, and all other <br /> damages, costs, expense and sums that Landlord may suffer or incur, or that may become <br /> due, by reason of any default of Tenant or failure by Tenant to comply with the terms and <br />
