NEW BUSINESS
VI. A Moved to Item III. B
VI.B Grant drain field easement on property owned at 9641-62-3897-00
Lee County owns a parcel of land located at Lot 13 Ivey Drive (off Beulah Brown
Road). The individual across the street, located at 3511 Ivey Drive has requested
Lee County grant an easement for her septic tank that impacts Lee County's land.
After receiving this request, staff researched to determined why the County owns the
land. In the Board of Commissioners'meeting minutes from November 16, 1992 in
which the County sought a CDBG grant for the Beulah Brown Road area for housing
rehab, relocation, water line extensions and road improvements. Specifically, in
1993 the County purchased Lot 13 Ivey Drive from CAMCO Builders for just
compensation. In the minutes from the August 19, 1996 Board meeting that state
specifically that lot was purchased to provide areas for septic tanks and drain fields
in connection with Beulah Broad Road CDBG project. The homeowner that utilizes
Lee County's land is the same owner from the 1990s and whose house had recently
been destroyed in a fire. Environmental Health Staff could not find a recorded
easement, the policies of requiring an easement may have changed, but is
necessary to receive one now. Since the intent of purchasing this land was for this
reason, staff is recommending the Board allow the easement and authorize the
Chair to sign any paperwork necessary. County Attorney Whitney Parrish stated that
she was contacted by a property owner regarding the granting of property for a
drainfield.
1992 - 11-16-92 Regular Meeting.pdf
Resolution for Lot 13.pdf
1992 - 11-16-92 Regular Meeting.pdf
964162389700_20211012.pdf
Motion: Motion to grant drain field easement on property owned at 9641-
62-3897-00.
Mover: Cameron Sharpe
For: 7 - Arianna Lavallee, Dr. Andre Knecht, Robert Reives, Cameron Sharpe,
Kirk Smith, Bill Carver, Mark Lovick
Motion Result: Passed
