1. That the lot located at 225 S. Steele Street, PIN 9642-79-1391-00 is hereby declared <br /> to be surplus to the needs of Lee County. <br /> 2. That the consideration for the conveyance is based on the following set of conditions, <br /> covenants and restrictions which shall be incorporated in the deed given by the <br /> County to Johnston Lee Harnett Community Action and which include: <br /> a. Johnston Lee Harnett Community Action will continue to seek state and <br /> federal grant funding to provide services to low to moderate income and <br /> homeless persons living in Lee County. <br /> b. Johnston Lee Harnett Community Action will not discriminate based on <br /> anyone's race, color, religion, sex or national origin. <br /> c. Johnston Lee Harnett Community Action will submit an annual report to the <br /> County summarizing the public services it has offered throughout the year. <br /> d. Johnston Lee Harnett Community Action will not lease the building located at <br /> 225 S. Steele Street to any other entity that does not meet the public purpose <br /> herein described or must seek prior written approval of the County. <br /> e. The deed will contain a clause that the property must be used for the public <br /> purpose of providing services to the homeless and low income persons of Lee <br /> County and in the event the property described above ceases to be used for the <br /> aforesaid public purpose, then in such event all right,title, and interest in the <br /> property will revert back to the County and the County shall have the right to <br /> immediately re-enter upon said premises and take and hold possession of said <br /> premises without let or hindrance. <br /> 3. That the Clerk to the Board is hereby authorized and directed to cause a notice <br /> summarizing the contents of this resolution to be published once in The Sanford <br /> Herald after the resolution is adopted and the property may be sold at any time after <br /> the ten(10)days after publication of the notice. <br /> 4. That the County Manager and the Chair of the Board of Commissioners are hereby <br /> authorized and directed to dispose of the property described herein by private sale to <br /> the non-profit corporation, Johnston Lee Harnett Community Action at no cost for the <br /> public purpose of providing services to the homeless and low income citizens of Lee <br /> County. <br /> Adopted this ZO'day of S p ember , 2021. <br /> 'f <br /> -isr"°' --� I*, ' Kirk D.
