2021-36 RESOLUTION Authorizing the Sale of Property Located at 225 S. Steele Street to Johnston Lee Harnett Community Action 9-20-2021

1. That the lot located at 225 S. Steele Street, PIN 9642-79-1391-00 is hereby declared to be surplus to the needs of Lee County. 2. That the consideration for the conveyance is based on the following set of conditions, covenants and restrictions which shall be incorporated in the deed given by the County to Johnston Lee Harnett Community Action and which include: a. Johnston Lee Harnett Community Action will continue to seek state and federal grant funding to provide services to low to moderate income and homeless persons living in Lee County. b. Johnston Lee Harnett Community Action will not discriminate based on anyone's race, color, religion, sex or national origin. c. Johnston Lee Harnett Community Action will submit an annual report to the County summarizing the public services it has offered throughout the year. d. Johnston Lee Harnett Community Action will not lease the building located at 225 S. Steele Street to any other entity that does not meet the public purpose herein described or must seek prior written approval of the County. e. The deed will contain a clause that the property must be used for the public purpose of providing services to the homeless and low income persons of Lee County and in the event the property described above ceases to be used for the aforesaid public purpose, then in such event all right,title, and interest in the property will revert back to the County and the County shall have the right to immediately re-enter upon said premises and take and hold possession of said premises without let or hindrance. 3. That the Clerk to the Board is hereby authorized and directed to cause a notice summarizing the contents of this resolution to be published once in The Sanford Herald after the resolution is adopted and the property may be sold at any time after the ten(10)days after publication of the notice. 4. That the County Manager and the Chair of the Board of Commissioners are hereby authorized and directed to dispose of the property described herein by private sale to the non-profit corporation, Johnston Lee Harnett Community Action at no cost for the public purpose of providing services to the homeless and low income citizens of Lee County.
