According to North <br /> Carolina General Statute 153A -149(c)(3) authorizes the County to spend monies on <br /> social service programs which are not governed by the social services statute. <br /> However, if the County wishes to donate the property, it will have to place covenants <br /> in the deed to ensure the entity continues to use the property for said public purpose. <br /> The proposed covenants include that Johnston Lee Harnett Community Action will <br /> continue to operate as a non-profit authorized to do business in the State of North <br /> Carolina and it will continue to utilize state and federal funding to help provide <br /> services to low income members of Lee County and will not discriminate services <br /> based on anyone's race, color, religion, sex or national origin. Johnston Lee Harnett <br /> Community Action is also unable to lease the property for profit. If the property were <br /> to ever stop being used for theses public purposes, it will revert back to the County. <br /> If the County decides to donate the property, the Board needs to adopt the <br /> accompanying resolution and authorize the Clerk to advertise the intent of the <br /> donation in The Sanford Herald. The closing on the property cannot occur until at <br /> least 10 days after the advertisement, to allow citizens the opportunity to contact the <br /> Board if they wish. After publication, staff will bring the property back to the Board to <br /> let them know of any responses from the public and then the Board can authorize <br /> the transfer. County Manager Dr. John Crumpton stated that a request was received <br /> in April for the donation of the building to the organization because they want to <br /> expand case management, homelessness, and housing services and they would like <br /> to get off the of the second floor since it is not ADA compliant. The staff <br /> recommendation is that the property be declared as surplus. Closing cannot occur <br /> until 10 days after advertisement for input and would be brought back to the board <br /> regarding any comments received before being transferred. The building cannot be <br /> sold by the donating party. Deed restriction would revert the property back to the <br /> County if operations were abandoned.
