Motion: Motion to approve update to UDO text amendment per North <br /> Carolina General Statute 160D. <br /> Mover: Cameron Sharpe <br /> For: 7 - Arianna Lavallee, Dr. Andre Knecht, Robert Reives, Cameron Sharpe, <br /> Kirk Smith, Bill Carver, Mark Lovick <br /> Motion Result: Passed <br /> V.E UDO Text Amendment for Mining and Quarries <br /> Planning Director Marshall Downey presented text amendments to the UDO that <br /> proposed to remove Section 4.16 Mining Special Use Overlay District and to <br /> update Table 4.6- 1 Permitted Use Matrix to add "Mining and Quarrying"as a <br /> permitted use, subject to supplemental development standards and approval of a <br /> Special Use Permit by the Board of Adjustment in the Residential Agriculture, <br /> Light Industrial, and Heavy Industrial zoning districts within the jurisdictions of the <br /> City of Sanford, Lee County and the Town of Broadway. This is a request that <br /> was brought from the Joint Planning Commission. A public hearing was held on <br /> May 19, 2021. Downey presented what the County currently does that was <br /> adopted in 2018. Currently under the UDO there is a two-step process 1. to apply <br /> for a mining overlay rezoning in either the green, blue and orange zones which is <br /> approved by the Board of Commissioners and 2. if approved, the applicant would <br /> also need to apply for a Special Use Permit which is approved by the Board of <br /> Adjustment. <br /> The Planning Board recommends Ordinance Option A as an alternative to what <br /> was adopted in 2018 which would remove the overlay zoning option and replace <br /> with allowing mining operations only in orange colored or heavy industrial areas <br /> or applicant would have to rezone to HI. Once zoned HI, the applicant would still <br /> need to apply for a special use permit which is the same as the current process. <br /> Ordinance Option B includes that the mining overlay would be removed so no <br /> zoning action would be required.
