lam11 <br /> O13 <br /> * ill 1p *- -144* <br /> MEMORANDUM ''s+11/.". c" <br /> `•; CAIiQ-:' 4RTERED <br /> TO: Lee County Board of Commissioners <br /> Dr. John Crumpton, County Manager <br /> FROM: Marshall Downey, Director of Community Development <br /> DATE: June 7, 2021 <br /> REF: Proposed UDO Text Amendments for NCGS 160D Updates <br /> Recommendation from the Planning Board <br /> The Planning Board met on May 19th and recommended that the Commissioners approve <br /> the UDO text amendment by a unanimous vote, with the following change: <br /> • UDO paragraph 3.1.5.3.3, the insert "with standing" be deleted and the paragraph <br /> be amended to include the language in section 160D 406, subparagraph D, first <br /> paragraph. <br /> Topics of discussion included the following: <br /> • this update is technical in nature and is required per recent changes in the North <br /> Carolina General Statues <br /> • this update must be adopted by July 1, 2021 so that the County may be compliant <br /> with state law <br /> Staff did not include the entire updated UDO as an Ordinance within this agenda packet. <br /> If, however, this text amendment is approved, the entire updated UDO as an Ordinance <br /> will be provided to the Board Chair, County Attorney, and County Clerk for their <br /> signatures. <br /> Information from the May 19, 2021 Public Hearing <br /> As was explained at the March 30,2021 joint workshop held for the Governing Boards and <br /> Planning Boards for all three jurisdictions,the proposed changes to the jointly adopted City <br /> of Sanford/Lee County/Town of Broadway Unified Development Ordinance (UDO), are <br /> triggered by recent changes in North Carolina General Statutes (commonly referenced as <br /> 160D changes)and are required in order to ensure that our UDO is in compliance with state <br /> law. The City hired a law firm that specializes in land use matters to review our UDO and <br /> make the changes needed in order to comply. This law firm has been working with staff <br /> for approximately a year on this project and we are confident of their expertise in this <br /> matter. All cities and counties in North Carolina must update their UDO/local zoning <br /> ordinance by July 1, 2021 in order to comply with state law, so we are not unique. The <br /> proposed UDO changes are posted on the City website at <br /> https://www.sanfordnc.net/766/Proposed-UDO-Changes. <br />
