STATE OF NORTH CAROLINA <br /> COUNTY OF LEE <br /> FOURTH AMENDMENT TO ROLL-OFF HAULING and FRONT <br /> LOAD DUMPSTER SERVICE AGREEMENT <br /> The County of Lee (hereinafter referred to as the "County") and Waste Industries, LLC <br /> (hereinafter referred to as the "Company") signed an original agreement on June 3. 2013 <br /> detailing the provisions of the Company providing solid waste and recycling services to the <br /> County. An amendment to the original agreement was signed on June 14. 2017, extending the <br /> tern of the agreement five years, ending on June 30. 2023. A second amendment was signed on <br /> April 15, 2019 allowing a comingled recycling processing fee of$62.00 per ton from July 1, <br /> 2019 to June 30. 2020. A third amendment signed May 18. 2020 allowing a comingled recycling <br /> processing fee of$132.00 per ton from July 1, 2020 to June 30, 2021. The Parties wish to make <br /> the following fourth amendment to the original agreement: <br /> Section 5: Rates; Payment <br /> Under Section (c). the Company may request an adjustment to rates due to fees and surcharges. <br /> Such request will not be reasonably withheld by the County. Due to the unforeseen impact of <br /> tariffs and the decline of worldwide markets for recycling material, the company is seeking <br /> compensation under this Section to cover the increased cost to process recycling. The County <br /> hereby agrees to amend the contract for one year to allow a comingled recycling processing fee <br /> of$132.00 per ton from July I. 2021 to June 30, 2022. In March of 2022 the Company and <br /> County will meet to review the cost of processing recycling materials to determine if changes <br /> need to he made to the fee or ifthe fee will continue after June 30. 2022. <br /> All other terms and conditions of this section remain the same. <br /> In witness whereof, the County and Contractor have executed this contract amendment as of this <br /> day and year first written: <br /> WASTE INDUSTRIES LLC COU 'T <br /> BY: '', / <br /> 131': <br /> Ted Hahets.
