JOINT PUBLIC HEARINGS WITH THE LEE COUNTY PLANNING BOARD <br /> III.A Zoning Map Amendment (Rezoning) Application and Staff Report <br /> Zoning Administrator Amy McNeill presented a request for a Zoning Map <br /> Amendment from Richard Oldham to rezone a 15 +/- acre portion of an 84 +/- acre <br /> tract of land addressed as 130 Rocky Fork Church Road from Light Industrial (LI) to <br /> Heavy Industrial (HI) in preparation for the future development of the site. This is a <br /> standard general use rezoning request, as opposed to a conditional rezoning <br /> request therefore, no site plan/subdivision plan or building plans are required as a <br /> part of the rezoning request. Mrs. McNeill provided a summary of land uses for light <br /> industrial and heavy industrial and a review of a site map showing the proposed <br /> rezoning site and surrounding properties. Staff is not in support of the rezoning <br /> request because it does not comply with the long-range plan designation for <br /> Countryside, which includes land uses such as schools, churches, houses, farmland, <br /> and forests - no industrial uses .The existing zoning of Light Industrial predates the <br /> adoption of the current land use plan by Lee County in November 2018 and would <br /> not be affected by this request. <br /> Chairman Smith opened the public hearing for comment. Amy McNeill received an <br /> e-mail from Pam Knight located at 327 Rocky Fork Church Road, who spoke <br /> against the project due to potential negative impact of increased traffic and uses <br /> that associate with heavy industrial. Donnie Oldham located at 2412 Brookwood <br /> Trail, Sanford, NC spoke in favor of the rezoning stating that he is trying to get the <br /> zoning upgraded to potentially have an asphalt or concrete plant serving the <br /> Sanford Contractors expansion. With no further comments received, Chairman <br /> Smith closed the public hearing. <br /> 001-REZ@130 Rocky Fork Church Rd-BINDER-REVISED.pdf <br /> III.B UDO Text Amendment and Staff Memo <br /> Planning Director Marshall Downey presented proposed UDO text amendments for <br /> NC General Statute 160D updates. On March 30th, 2021 there was a joint meeting <br /> where the Board heard from a consultant from Parker Poe Law Firm regarding <br /> changes made to the UDO with the purpose to comply with the new state law <br /> changes to NC General Statute Section 160D. These changes replace 153A <br /> regarding authority for zoning and land use and combined into one set of rules for <br /> counties and municipalities. Every article of the UDO had some level of changes <br /> with the majority being reference changes. The website, <br /> www.sanfordnc.net/766/proposed-udo-changes lists the changes to the UDO that <br /> the public has had and will continue having access to review the changes. Chairman <br /> Smith opened the public hearing for comment. No one spoke in favor or against the <br /> proposed UDO changes.
