MEMORANDUM OF UNDERSTANDING BETWEEN <br /> CENTRAL CAROLINA COMMUNITY COLLEGE AND LEE COUNTY GOVERNMENT <br /> This Memorandum of Understanding("MOU")is entered into on this date, Moak_3 ,2021,between Central <br /> Carolina Community College(hereafter"College")and Lee County Government(hereafter"County"),collectively referred to as"the <br /> Parties." <br /> WHEREAS,the College is a public two-year college serving the residents of Lee County;and, <br /> WHEREAS,the County,as the government for Lee County, is tasked with improving the quality of life for the citizens of <br /> Lee County; <br /> WHEREAS,the College and the County desire to establish a mutually beneficial relationship involving the operation of an <br /> Educational and Governmental Access Channel for the citizens of Lee County <br /> NOW,THEREFORE, in consideration of the promises and covenants of the parties herein contained,and other good and <br /> valuable consideration,the receipt and sufficiency of which are hereby acknowledged,the parties do hereby agree to the following: <br /> I. The County shall provide capital and operating cost funding in order to allow the College to act as the Educational and <br /> Governmental Access Channel operator for Lee County. <br /> II. The College shall obtain and display content including,but not limited to,live County Board of Commissioner meetings, <br /> recorded County Board of Commissioner meetings,other media from County Departments as requested,and other <br /> sources of media. <br /> III. The College shall provide internet hosting through County-provided equipment for the purpose of maintaining active <br /> websites for both the College and the County so that the public and all staff may have access to live and recorded video <br /> content. <br /> IV. The College shall operate both the Educational and Governmental Access Channels and distribute programming on those <br /> channels that meet the requirements as laid out by the North Carolina Department of Revenue in NC G.S. 105-164, <br /> 44j(b)and NC G.S.66-357. <br /> V. The College,as operator,shall certify annually that the qualifying criteria have been met for the above general statutes <br /> for the fiscal year. <br /> VI. The County shall provide necessary funding to support the College with the equipment and labor required to accomplish <br /> the aforementioned tasks. <br /> VII. The Parties shall work together to meet current and future requirements that may arise from entities and laws including, <br /> but not limited to,the Federal Communications Commission and the Americans with Disabilities Act. <br /> VIII. The Parties'staff shall maintain a continuum of communication throughout the fiscal year in order to discuss,plan,and <br /> resolve any existing or future fiscal,technological, logistical,or legal issues regarding the operation of these channels. <br /> IX. The County's IT Director and the College's Broadcast Production Technologies Department's chosen staff members are <br /> the listed points of contact for matters relating this Memorandum of Understanding. <br /> X.
