• Pollution Legal Liability for sudden and accidental occurrences - $5,000,000 per <br /> occurrence, $10,000,000 annual aggregate; <br /> • MCS-90 Endorsement for hazardous materials transportation - $5,000,000. An <br /> excess liability policy(Umbrella) may be used in conjunction with specific policies to <br /> satisfy required limits. <br /> • The Contractor shall maintain liability insurance in the amount of at least $1,000,000 <br /> covering The Contractor's obligations under this Agreement, including but not limited to <br /> injuries and damages arising out of vandalism, theft, fire, and explosion at the Site. <br /> ARTICLE 13 <br /> Licenses <br /> The Contractor certifies that, on the day of collection, transportation, and disposal of the Waste, <br /> it or its subcontractors will have: <br /> A. Valid Environmental Protection Agency ("EPA") identification numbers for collection, <br /> packaging, transportation, storage and disposal of hazardous and acutely hazardous <br /> wastes; and <br /> B. A valid North Carolina or other applicable permits for all of the above activities; and <br /> C. Any other license or permit required by federal or state law to engage in the activities <br /> provided for herein. <br /> ARTICLE 14 <br /> Health and Safety <br /> The Contractor shall be responsible for initiating, maintaining and supervising all safety <br /> precautions and programs in connection with the work. Contractor shall take all necessary <br /> precautions for the safety of, and shall provide the necessary protection to prevent damage, <br /> injury or loss to all from the work and other persons who may be affected thereby. <br /> ARTICLE 15 <br /> Non-Discrimination in Employment <br /> Contractor shall not discriminate against any employee or applicant for employment because of <br /> age, sex, race, creed, or national origin. Contractor shall take affirmative action to ensure that <br /> applicants are employed and that employees are treated during employment without regard to <br /> their age, sex, race, creed, or nation origin. In the event Contractor is determined by the final <br /> order of an appropriate agency or court to be in violation of any non-discrimination provision of <br /> federal, state or local law or this provision, this Agreement may be canceled, terminated or <br /> Page 5 of 9 <br />
