The County agrees to the following: 1. The County will sell fuel to Agency at cost. 2. The County will not unreasonably deny a request from the Agency to purchase the fuel. 3. The County will submit an invoice to the Agency on a monthly basis. 4. In the event the County must limit or deny the purchase of fuel, the County will attempt to notify the Agency of the availability or unavailability of fuel. Since all fuel is purchased from a third -party provider, the County does not warrant the quality of the fuel and as such, Agency hereby agrees to indemnify County from any liability associated with any damage or loss caused by said fuel. While the County aims to obtain fuel at the best available market rate based on locality, due to economic fluctuations, rates for the purchase of fuel from the County are subject to change at any given time. E -Verify Certification: Pursuant to N.C.G.S. 143-48.5 and N.C.G.S. 147-33-95(g), Contractor ("CWHC") hereby certifies that the Contractor, and the Contractor's subcontractors, complies with the requirements of Article 2 of Chapter 64 of the North Carolina General Statutes, including the requirement for each employer with more than 25 employees in North Carolina to verify the work authorization of its employees through the federal E -Verify system. E -Verify System Link: www.uscis.gov Iran -Divestment Act Certification: Contractor certifies that the contractor, and all subcontractors are not on the Iran Final Divestment List ("List") created by the North Carolina State Treasurer pursuant to N.C.G.S. 147-86.58. Contractor shall not utilize any subcontractor that is identified on the list. Governing Law: In the event either party must commence legal action in order to enforce any rights under this contract, venue for any and all disputes shall be Lee County, North Carolina.
