<<on~ 1~ 38¢ <br />Commissioner Lila P. Nielsen moved the adoption of the following <br />resolution: <br />WHEREAS, the office of Sheriff is established by <br />Article VII, Section 2, of the Constitution of the State of <br />North Carolina; and <br />WHEREAS, the General Assembly of North Carolina <br />has given each sheriff the exclusive right to hire, supervise <br />and discharge the employees of his office under North Carolina <br />General Statute 153A-103; and <br />WHEREAS, the General Assembly of North Carolina has <br />provided for the grounds and procedure for removal of sheriffs <br />by the enactment of Article 2, Chapter 128, General Statutes of <br />North Carolina: and <br />WHEREAS, written affidavits concerning the conduct of <br />Sheriff H. R. Thomas were presented to the Board of Commiss- <br />ioners for Lee County on the erroneous assumption that said <br />Board had disciplinary authority over the Sheriff; and <br />WHEREAS, the Board responded to said affidavits and <br />referred said affidavits to The Honorable John Twisdale, <br />District Attorney, Eleventh Prosecutorial District, and <br />WHEREAS, The Honorable John Twisdale, District <br />Attorney, has responded to the Board by his letter dated <br />February 2, 1982, a copy of which is attached hereto; <br />NOW THEREFORE, BE IT RESOLVED by the Board of <br />Commissioners for Lee County, that the District Attorney of <br />the Eleventh Prosecutorial District take such action or actions <br />as he deems appropriate and justified based upon the facts as <br />ascertained by the investigation conducted by his office relative <br />to the conduct of Sheriff H. R. Thomas. <br />Commissioner John E. Dotterer seconded the motion and upon a <br />vote the resolution was adopted by a majority vote in which Commissioners Dotterer, <br />Nielsen, Wicker and Harmon voted for it and Commissioner Funderburke voted <br />against it. <br />Commissioner Lila P. Nielsen moved that the Board go into <br />Executive Session to discuss matters pertaining to litigation. The motion was <br />duly seconded and upon a vote was unanimously adopted. <br />
