I . <br />1® <br />0 <br />°J <br />BOOK 10 PA, E 557-.' <br />RESOLUTION OF THE BOARD OF COMMISSIONERS <br />OF LEE COUNTY PROVIDING FOR THE ESTABLISHMENT <br />OF FIRE/SERVICE DISTRICTS IN LEE COUNTY <br />WHEREAS, by G.S. Section 153A-9 (39) the Board of County <br />Commissioners of Lee County is authorized and empowered to provide for <br />the . organization, equipment, maintenance and the governing of fire <br />companies; and <br />- WHEREAS, the Board of Commisssioners of Lee County is of the <br />opinion and have found and determined that it is for the best interest <br />and necessary for the protection of the citizens of the.said County and <br />their property to encourage and financially aid in the equipment, the <br />maintenance and government of volunteer fire departments in said County <br />for the protection of public schools, homes, farm buildings and other <br />property, and to establish a protective fire fighting organization for <br />the purpose of civil defense; and <br />WHEREAS, it is contemplated that one or more fire departments <br />located in proposed Fire Protection/Service Districts in Lee County will <br />meet the qualifications and regulations as outlined in this resolution; and <br />WHEREAS, it is contemplated that said proposed Fire Protection/Service <br />Districts in Lee County will be established as Fire/Service Districts under <br />the minimum qualifications as specified by the North Carolina Fire Insurance <br />Rating Bureau; . <br />NOW, THEREFORE, BE IT RESOLVED: <br />Section 1. That for the purpose of carrying out the terms and <br />provisions of this resolution a commission be, and it is hereby created to be, <br />known as the "Lee County Fire/Service Districts Commission Said commission <br />to be composed of three (3) members who shall hold office for a period of one <br />year or until their successors are elected and gpalified. One member shall be <br />elected by the Lee County Board of Commissioners and shall be a member of said <br />Board, which said member shall be known as the Lee County Fire Commissioner; <br />one member shall be the Director of Emergency Management for Lee County; and one <br />member shall be the President of the Lee County Volunteer Firemen's Association. <br />The Commission shall elect its own president and secretary and shall <br />make reports of its activities to the Lee County Board of Commissioners. <br />(a) When any volunteer department of a fire/service district shall <br />make application to the Lee County Board of Commissioners to receive financial <br />aid from the said County under this resolution, the said Fire Commission shall <br />inspect the said fire department, its equipment, personnel, and organization, <br />method of operation, and shall file a written report to the said Lee County <br />Board of Commissioners signifying whether or not such volunteer department <br />meets the minimum requirements and specifications therein referred to, which <br />specifications are made a part of this resolution and are taken from the minimum <br />requirements of the North Carolina Insurance Rating Bureau; <br />(b) The said Fire Commission will make annual inspection to <br />determine if said fire departments are continuing to meet the minimum standards <br />as specified, and shall notify the Lee County Board of Commissioners and the <br />Fire Insurance Rating Bureau as outlined hereunder; continuing failure, as out- <br />lined, will terminate the financial agreement or support of Lee County. Said <br />Commission shall, from time to time, review the specifications as set out in <br />this resolution, and shall recommend to the Lee County Board of Commissioners <br />any amendments or changes, which the said Commissioners may deem advisable.' <br />Section 2. Each fire protection/service district will qualify for and <br />set up its own organization for administering the Firemen's Relief Fund as out- <br />lined in the Law creating the North Carolina Firemen's Relief Fund, G.S. 118-1 <br />through 118-17. The Lee County Commissioners shall appoint two members to serve <br />on the Local Firemen's Relief Fund Board of Trustees. The Trustees shall be <br />allowed to carry out their duties as specified in the Law creatinq the North <br />Carolina Firemen's Relief Fund. <br />b <br />x -j <br />
