government receives state appropriations for a building project or other state
grant funds for a building project, including project done by a private entity on
a facility to be leased or purchased by the local government unit, where the
project cost is $100,000 or for any building projects costing over$300,000. In
addition to the formal solicitation, the local government shall have a verifiable
10% goal for participation by minority businesses in the total value of work. A
local unit of government may apply a different standard if the goal was
adopted prior to December 1, 2001 and had and continues to have a
sufficiently strong basis in evidence to justify the goal. If a building
construction and repair contract falls into the $300,000 and above cost
range, then both the local government unit and the bidder must follow the
County's outreach plan, which is now being presented as an addendum to
the purchasing policy of the Board. The local government must solicit bids
following formal good faith efforts and document such efforts to the
Department of Administration Office for Historically Underutilized Businesses
site. The bidders must also follow good faith effort in submitting bids on
projects and ensuring that they meet the 10% goal adopted by Lee County
and they must also report their efforts to the Office of Historically
Underutilized Businesses. Staff is going to include requirements that these
same solicitation goals and plans for all construction and repair contracts as
opposed to only building construction and repair. NCGS 143-131 requires
that construction contracts costing between $30,000 and$300,000 require
public entities to follow informal solicitation of minority participation. The local
government must maintain a record of those businesses solicited and report
certain data to the Office for Historically Underutilized Businesses. The 1990
Resolution adopted by the Board has been updated and the Board is now
being asked to adopt the policy as part of an addendum to the purchasing
policy.
Draft Policy Resolution 2.27.20.doc
Original 1990 Policy.pdf
Final Memo to Board.docx
Final Policy HUB Requirements.doc
Motion: Motion to waive the policy regarding taking action on items following a
public hearing.
Mover: Dr. Andre Knecht
For: 6 - Amy Dalrymple, Arianna Del Palazzo, Dr. Andre Knecht, Robert Reives,
Cameron Sharpe, Kirk Smith
Absent: 1 - Kevin Dodson
Motion Result: Passed
Motion: Motion to adopt Lee County's Outreach Plan and Goal for
participation for minority businesses in building construction and repair
contracts.
Mover: Kirk Smith
For: 6 - Amy Dalrymple, Arianna Del Palazzo, Dr. Andre Knecht, Robert Reives,
Cameron Sharpe, Kirk Smith
Absent: 1 - Kevin Dodson
Motion Result: Passed
5
