government receives state appropriations for a building project or other state <br /> grant funds for a building project, including project done by a private entity on <br /> a facility to be leased or purchased by the local government unit, where the <br /> project cost is $100,000 or for any building projects costing over$300,000. In <br /> addition to the formal solicitation, the local government shall have a verifiable <br /> 10% goal for participation by minority businesses in the total value of work. A <br /> local unit of government may apply a different standard if the goal was <br /> adopted prior to December 1, 2001 and had and continues to have a <br /> sufficiently strong basis in evidence to justify the goal. If a building <br /> construction and repair contract falls into the $300,000 and above cost <br /> range, then both the local government unit and the bidder must follow the <br /> County's outreach plan, which is now being presented as an addendum to <br /> the purchasing policy of the Board. The local government must solicit bids <br /> following formal good faith efforts and document such efforts to the <br /> Department of Administration Office for Historically Underutilized Businesses <br /> site. The bidders must also follow good faith effort in submitting bids on <br /> projects and ensuring that they meet the 10% goal adopted by Lee County <br /> and they must also report their efforts to the Office of Historically <br /> Underutilized Businesses. Staff is going to include requirements that these <br /> same solicitation goals and plans for all construction and repair contracts as <br /> opposed to only building construction and repair. NCGS 143-131 requires <br /> that construction contracts costing between $30,000 and$300,000 require <br /> public entities to follow informal solicitation of minority participation. The local <br /> government must maintain a record of those businesses solicited and report <br /> certain data to the Office for Historically Underutilized Businesses.
