064 <br />MEMORANDUM <br />coU gpNpQ <br />yO `H CAF �e Cy4RTEPEO �B�p <br />TO: Lee County Board of Commissioners <br />Lee County Planning Board <br />John Crumpton, County Manager <br />FROM: Marshall Downey, Assistant Director of Planning and Development <br />DATE: February 20, 2012 <br />REF: Public Hearing regarding seven (7) possible text amendments to the Unified <br />Development Ordinance <br />The following are several corrective updates to the UDO as recommended by Planning staff. <br />Please note that these amendments were resented to the Joint Planning Commission for <br />consideration at a meeting on January 26` of this year. After some discussion, the Joint <br />Planning Commission recommended that all of the attached amendments be forwarded to the <br />three jurisdictions for public hearing. <br />Proposed Amendment 1. In August of this past year, the General Assembly updated NC <br />General Statute 136 -32 in regards to how signage shall be regulated within the right -of -way of <br />State maintained roadways. Additionally, subsection (f) of GS 136 -32 further clarified how <br />the State rules apply to municipalities. A copy of the full changes to GS 136 -32 (known as <br />SB 315) is attached. <br />In a nutshell, GS 136 -32 was updated to allow for political signs to be placed in the rights -of- <br />way of State roadways provided that the following conditions are met: <br />• The permittee must obtain the permission of any property owner of a residence, <br />business, or religious institution fronting the right -of -way where a sign would be <br />erected. <br />• No sign shall be permitted in the right -of -way of a fully controlled access highway. <br />• No sign shall be closer than three feet from the edge of the pavement of the road. <br />• No sign shall obscure motorist visibility at an intersection. <br />• No sign shall be higher than 42 inches (3'6 ") above the edge of the pavement of the <br />road. <br />• No sign shall be larger than 864 square inches (6 sq. ft.) <br />• No sign shall obscure or replace another sign. <br />• Signs may be placed during the period beginning on the 30th day before the beginning <br />date of "one- stop" early voting* under G.S. 163 -227.2 and ending on the 10th day <br />
