Adopt Resolution Regarding National Opioid Litigation <br /> On April 8, 2019, the Lee County Board of Commissioners filed suit against <br /> various distributors and manufacturers of opioids to join the national opioid <br /> litigation. Once the suit was filed, the case was transferred to the multi-district <br /> litigation in the United States District Court for the North District of Ohio, <br /> under the authority of Federal Judge Polster. As the national team continues <br /> to prepare cases for trial, there is also settlement talks with the defendants <br /> taking place. The Federal Court has formed a negotiation class under <br /> Federal Rules of Civil Procedure Rule 23. Counties and Cities who have filed <br /> suit have until November 22, 2019 to "opt-out"of the negotiation class if <br /> desired. If the plaintiffs stay in the class, any settlement will be binding on the <br /> entity if approved by a supermajority of 75% of the voting class members and <br /> if approved by the Court. Upon the advice of national and local counsel, Lee <br /> County has decided to remain in the negotiation class and will reflect this <br /> decision in an adopted Resolution. <br /> Motion: Motion to adopt Resolution regarding National Opioid Litigation <br /> as presented, a copy of which is attached to these minutes and by this <br /> reference made a part hereof. <br /> Mover: Robert Reives <br /> For: 5 - Amy Dalrymple, Kevin Dodson, Dr. Andre Knecht, Robert Reives, <br /> Cameron Sharpe, <br /> Against: 2 - Arianna Del Palazzo Kirk Smith <br /> Motion Result: Passed <br /> Resolution Final Negotiation Class.docx <br /> V.
