EXHIBIT "A" U 300-K 11 239 ;l'• This contract and the sale herein provided for are expressly contingent upon Well No. 3 in Owl's Nest water system and Well No. 2 in ' Trail's End water system, having a combined uninterrupted flow of 140 gallons per minute, and in the event said wells do not have a combined ,'.!uninterrupted flow of 140 gallons per minute, then the Buyer, at its option, T. declare this contract terminated and rescinded and of no further force ;.nand effect, Z Buyer shall promptly have said wells tested and for the i rivilege of testing said wells shall pay to the Seller the sum of $3, 500, 00, `which sum shall not be refundable. +3.• If the Buyer fails to have said wells tested on or before the '..t closing date specified, then it shall forfeit the opportunity to make such tests and shall be bound by the terms of the offer as if such privilege did not exist. ~4. This contract and the sale herein provided for are expressly I' a contingent upon Lee County receiving fee simple title to the Trail's End ~water system, as described in Exhibit "C" attached hereto, free and clear of all encumbrances, at no additional cost to the Buyer, on or before closing, 5• It is understood and agreed that the Buyer and its agents, •`-!+servants and employees may go upon the lands where said water system is ..,,situate, for the purpose of making tests, to include pump tests, chemical analysis and any other kind of tests; provided that said tests shall not unduly interrupt the use of said system by the patrons thereof nor will any test con- f-, iducted by the Buyer pollute or contaminate said system, In the event the option is:exercised and Buyer purchases the 1ril system, the Seller is to be permitted to make its own taps on said lots it !i owns at the time of the sale in said subdivision or if the Seller so desires, the Buyer will make the taps at the contract price.
