Commissioner Reives moved to approve the zoning map amendment for the 10.4 acres <br />off of Eakes Road, a copy of which is attached to these minutes and by this reference made a <br />part hereof. UDO Text Amendment to update the City of Sanford's Public Works Director Certificate. <br />Planning and Community Development Director Marshall Downey presented a text <br />amendment to the jointly adopted City of Sanford/Lee County/Town of Broadway Unified <br />Development Ordinance, Appendix B Specifications of Forms to be Submitted, B-4 Subdivision <br />Plats, to revise the Public Works Certificate. Commissioner Smith moved to approve the UDO <br />text amendment to update the City of Sanford's Public Works Director Certificate, a copy of <br />which is attached to these minutes and by this reference made a part hereof. Request to appear from Therese Vick on behalf of Blue Ridge Environmental Defense <br />League. <br />Therese Vick appeared on behalf of the Blue Ridge Environmental Defense League as a <br />member of the Lee County Chapter known as EnvironmentaLee. The organization had a <br />consultant look at the site studies for the proposed coal ash site at Colon. She shared the <br />findings from the report with the Board and provided an update on coal ash. On June 21, 2019 <br />DEQ directed CHARA to submit a ground and surface water plan. A consultant reviewed the <br />Chatham County Brick Haven site. After problems were identified at the Chatham County site, <br />BREDL asked the consultant to review the Lee County site. They are still in litigation with DEQ <br />regarding the issuance of the permit at the Chatham County site. CHARA, according to the <br />Rant, is having some financial challenges. BREDL has tried to get information regarding <br />CHARA's intent related to the site. The current permit is valid until 2025. There is a review next <br />year, which is required by state law. They have a permit to construct and a permit to operate <br />until 2025. The consultant's report looked at the site and in his opinion the largest concern was <br />the lack of a full geologic assessment of the site prior to the issuance of the permit. The site <br />would need to do shallow and deep monitoring wells, while currently they only do shallow <br />monitoring, to pick up contamination to prevent a release. Without this, a release could occur <br />without detection by the monitoring well network. DEQ has asked for a groundwater assessment <br />work plan which has been completed. The facility is currently permitted for a structural fill <br />benefited reuse. Jay Holly was the consultant that performed the work on behalf of BREDL.
