NNCAPHA <br />North Carolina Alliance of Public Health Agencies (NCAPHA) <br />Staffing Agreement <br />North Carolina Alliance of Public Health Agencies, Inc., entered into effective as of <br />July 1, 2019,with its principal office located at 222 North Person Street, Suite 208, Raleigh, <br />North Carolina 27601 ("Agency"), and Lee County Health Department, with its principal <br />office located at 106 Hillcrest Drive, Sanford, NC 27330 ("Client") agree to the terms and <br />conditions set forth in this Staffing Agreement (the "Agreement"). <br />Agency Duties and Responsibilities <br />Agency will: <br />a. Recruit, screen, interview, hire, and assign its employees ("Assigned Employees") <br />to perform tasks in accordance with Client's specifications as described to <br />Agency in writing for staffing under Client's supervision and will be the common <br />law employer of Assigned Employees; <br />b. Pay each Assigned Employee's wages and provide them with the benefits that <br />Agency offers to them; <br />C. Pay, withhold, and transmit payroll taxes; provide unemployment insurance <br />and workers' compensation benefits; and handle unemployment and workers' <br />compensation claims involving Assigned Employees; <br />d. Require Assigned Employees to sign agreements (in the form of Exhibit A) <br />acknowledging that they are not entitled to holidays, vacations, paid time off, <br />disability benefits, insurance, pensions, or retirement plans, or any other benefits <br />offered or provided by Client; <br />e. Comply with federal, state and local labor and employment laws applicable to <br />Assigned Employees, including the Immigration Reform and Control Act of <br />1986; the Internal Revenue Code ("Code"); the Employee Retirement Income <br />Security Act ("ERISA"); the Health Insurance Portability and Accountability Act <br />("HIPAA"); the Family Medical Leave Act; Title VII of the Civil Rights Act of <br />1964; the Americans with Disabilities Act; the Fair Labor Standards Act; the <br />Consolidated Omnibus Budget Reconciliation Act ("COBRA"); the Uniformed <br />Services Employment and Reemployment Rights Act of 1994. <br />f. In compliance with Section 420.302(b) of the Medicare regulations, until the <br />expiration of four years after the furnishing of services provided under this <br />Agreement, Agency will make available to the Secretary, U.S. Department of <br />Health and Human Services, the U.S. Comptroller General, and their <br />representatives, this Agreement and all books, documents and records necessary <br />to certify the nature and extent of the costs of those services; <br />
