025 <br />The Consultant further covenants that in the performance of this Agreement, no person <br />having any such interest shall be employed. <br />F. Nondiscrimination Section 109 of the Housing and Community Development Act of <br />1974 <br />No person in the United States shall on the grounds of race, color, national origin, or sex <br />be excluded from participation in, be denied the benefits of, or be subjected to <br />discrimination under any program or activity funded in whole or in part with funds made <br />available under this title. <br />G. Age Discrimination Act of 1975, as amended - Nondiscrimination on the Basis of Age <br />No qualified person shall on the basis of age be excluded from participation in, be denied <br />the benefits of, or otherwise be subjected to discrimination under any program of activity <br />which receives or benefits from Federal Financial assistance. <br />H. Section 504 of the Rehabilitation Act of 1973, as amended - Nondiscrimination on the <br />Basis of Handicap <br />No qualified handicapped person shall, on the basis of handicap be excluded from <br />participation in, be denied the benefits of, or otherwise be subjected to discrimination under <br />any program or activity which receives or benefits from Federal Financial assistance. <br />I. Executive Order 11246 <br />During the performance of this Agreement, the Consultant agrees as follows: <br />1. The Consultant shall not discriminate against any employee or applicant for <br />employment because of race, creed, sex, color or national origin. The Consultant will <br />take affirmative action to ensure that applicants are employed, and that employees are <br />treated during employment, without regard to their race, creed, sex, color, or national <br />origin. Such action shall include, but not be limited to the following: employment, <br />upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or <br />termination, rates of pay or other forms of compensation; and selection for training, <br />including apprenticeship. The Consultant agrees to post in conspicuous places, <br />available to employees and applicants for employment, notices to be provided by the <br />County setting forth the provisions of this non - discrimination clause. <br />2. The Consultant will, in all solicitation or advertisements for employees placed by or on <br />behalf of the Consultant, state that all qualified applicants will receive consideration for <br />employment without regard to race, creed, color, sex, or national origin. <br />3. The Consultant will cause the foregoing provisions to be inserted in all subcontracts for <br />any work covered by this Agreement so that such provisions will be binding upon each <br />Agreement for Professional Services 7 <br />Lee County FY 2011 CDBG -SSH Application <br />
