t ncm 11 ` 55 A RESOLUTION ORDERING THE CLOSING OF THAT PORTION OF DOGWOOD DRIVE east of Lot No. 8A to a point where a line drawn from the northeast corner of Lot No. 7 where it intersects the southeast corner of Lot No. 14 as shown on map of Willett's Lake Subdivision recorded in Plat Cabinet 2, Slide 593, Lee County Registry. WHEREAS, a petition by James E. Johnson and Irene C. Johnson, was presented to the Board of County Commissioners for the County of Lee at a meeting on July 16, 1984 requested that that portion of Dogwood Drive east of Lot No. 8A to a point where a line drawn from the northeast corner of Lot No. 7 where it intersects the southeast corner of Lot No. 14 as shown on map of Willett's Lake Subdivision recorded in Plat Cabinet 2, Slide 593, Lee County Registry be closed pursuant to the authority contained and under the procedure outlined in North Carolina General Statutes 153A-241; and WHEREAS, the said Board of Commissioner of the County of Lee, by resolution duly adopted and fixed August 20, 1984, at 7:00 o'clock P.M. as the time for the public hearing required by G.S. 153A-241 and directed that notice of said hearing be given as required by law; and WHEREAS, it appears that the only persons, firms or corporation owning property abutting on that portion of Dogwood Drive east of Lot No. 8A to a point where a line drawn from the northeast corner of Lot No. 7 where it intersects the southeast corner of Lot No. 14 as shown on map of Willett's Lake Subdivision recorded in Plat Cabinet 2, Slide 593, Lee County Registry sought to be closed are the petitioners, James E. Johnson and wife, Irene C. Johnson; and WHEREAS, it appears from the affidavit of publication in the Sanford Daily Herald, a newspaper published in Lee County, North Carolina, that said notice was published on July 28, August 4, 11 and 18, 1984; and WHEREAS after full and complete consideration of the matter and after having granted full and complete opportunity for all interested persons to appear and register any objections that they might have with respect to the closing of said Drive; and WHEREAS, it appears to the satisfaction of the said Board of Commissioners of Lee County that the closing of said Drive is not contrary to the public interest and that no individuals, firms, corporations or others owning property, either abutting the drive or in the vicinity thereof, or in the block in which said Drive is located, will as a result of said closing, be thereby deprived of reasonable means of ingress and egress to their property; and NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners for the County of Lee that the portion of Dogwood Drive east of Lot No. 8A to a point where a line drawn from the northeast corner of Lot No. 7 where it intersects the southeast corner of Lot No. 14 asshown on map of Willett's Lake Subdivision recorded in Plat Cabinet 2, Slide 593, Lee County Registry, is hereby ordered closed in accordance with and pursuant to the provisions of General Statutes of North Carolina 153A-241. The Clerk for the Board of Commissions for the County of Lee is hereby ordered and directed to file in the office of the Registry of Deeds of Lee County a certified copy of this resolu- tion, a copy of the published notice with publisher's affidavit attached, and affidavit that notice was mailed to property owners. This resolution duly passed this the 20th day of August, 1984.
