t <br />ncm 11 ` 55 <br />A RESOLUTION ORDERING THE CLOSING OF THAT PORTION OF DOGWOOD <br />DRIVE east of Lot No. 8A to a point where a line drawn from <br />the northeast corner of Lot No. 7 where it intersects the <br />southeast corner of Lot No. 14 as shown on map of Willett's <br />Lake Subdivision recorded in Plat Cabinet 2, Slide 593, Lee <br />County Registry. <br />WHEREAS, a petition by James E. Johnson and Irene C. <br />Johnson, was presented to the Board of County Commissioners for <br />the County of Lee at a meeting on July 16, 1984 requested that <br />that portion of Dogwood Drive east of Lot No. 8A to a point where <br />a line drawn from the northeast corner of Lot No. 7 where it <br />intersects the southeast corner of Lot No. 14 as shown on map <br />of Willett's Lake Subdivision recorded in Plat Cabinet 2, Slide <br />593, Lee County Registry be closed pursuant to the authority <br />contained and under the procedure outlined in North Carolina <br />General Statutes 153A-241; and <br />WHEREAS, the said Board of Commissioner of the County of <br />Lee, by resolution duly adopted and fixed August 20, 1984, at <br />7:00 o'clock P.M. as the time for the public hearing required <br />by G.S. 153A-241 and directed that notice of said hearing be <br />given as required by law; and <br />WHEREAS, it appears that the only persons, firms or <br />corporation owning property abutting on that portion of Dogwood <br />Drive east of Lot No. 8A to a point where a line drawn from the <br />northeast corner of Lot No. 7 where it intersects the southeast <br />corner of Lot No. 14 as shown on map of Willett's Lake Subdivision <br />recorded in Plat Cabinet 2, Slide 593, Lee County Registry sought <br />to be closed are the petitioners, James E. Johnson and wife, <br />Irene C. Johnson; and <br />WHEREAS, it appears from the affidavit of publication in <br />the Sanford Daily Herald, a newspaper published in Lee County, <br />North Carolina, that said notice was published on July 28, August <br />4, 11 and 18, 1984; and <br />WHEREAS after full and complete consideration of the matter <br />and after having granted full and complete opportunity for all <br />interested persons to appear and register any objections that <br />they might have with respect to the closing of said Drive; and <br />WHEREAS, it appears to the satisfaction of the said Board <br />of Commissioners of Lee County that the closing of said Drive <br />is not contrary to the public interest and that no individuals, <br />firms, corporations or others owning property, either abutting <br />the drive or in the vicinity thereof, or in the block in <br />which said Drive is located, will as a result of said closing, <br />be thereby deprived of reasonable means of ingress and egress <br />to their property; and <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners <br />for the County of Lee that the portion of Dogwood Drive east of <br />Lot No. 8A to a point where a line drawn from the northeast <br />corner of Lot No. 7 where it intersects the southeast corner of <br />Lot No. 14 asshown on map of Willett's Lake Subdivision recorded <br />in Plat Cabinet 2, Slide 593, Lee County Registry, is hereby <br />ordered closed in accordance with and pursuant to the provisions <br />of General Statutes of North Carolina 153A-241. <br />The Clerk for the Board of Commissions for the County of Lee <br />is hereby ordered and directed to file in the office of the <br />Registry of Deeds of Lee County a certified copy of this resolu- <br />tion, a copy of the published notice with publisher's affidavit <br />attached, and affidavit that notice was mailed to property owners. <br />This resolution duly passed this the 20th day of August, <br />1984. <br />Chairman <br />Attest: NORTH CAROLINA, LEE COON <br />Precsnted for registration on theL..( ..day <br />Bv: <br />Clerk of at <br />recorded in Bctk...... .L._....page.,.,S.`-.1Z&_ <br />Pattie W.
