Private Roads. <br />Private roads shall be allowed in subdivisions where all lots created <br />are an average of five acres or greater in size with no lots being smaller <br />than three acres-in size. The acreage of each tract is determined by the <br />area located within lot lines. Tracts Larger than ten acres will not be <br />included when caLcuLating the average lot size in the subdivision. All land <br />within the lot lines except public rights-of-way will be included in the lot <br />area. <br />The following stipulations shall apply to subdivision plats containing <br />private roads: <br />A. The.subdivisions may not embrace or put any part of a proposed <br />throughfare or street shown on the Lee County Throughfare Plan. <br />B. Developers shall. sign a certificate attesting the fact that an instru- <br />ment will be recorded with the final plat which guarantees: <br />1. Right of access to any private road within the subdivision by <br />all lots served by the road. <br />2. A maintenance agreement as specified in Paragraph 20 of this <br />ection. <br />3. The future redivision of lots into smaller lots is not permitted <br />• unless plans for said roads are submitted to and approved by the <br />Division of Highways and until said roads are built according to <br />approved plans or proper assurance of completion are accepted by <br />the Planning Board. This requirement shall be stated on the plat. <br />C. Design and Construction Standards for Private Roads. The following <br />design and construction standards shall apply to private roads. <br />1. The minimum width of rights-of-way shall be fifty (50) feet. <br />Where necessary for adequate drainage additional right-of-way <br />may be required. <br />2. The travel way width shall be not less than sixteen (16) feet, <br />with a crown not Less than one-half inch per foot fall. <br />3. Shoulders shall not be less than four (4) feet in width. <br />4. Ditches shall be provided where necessary for proper drainage. <br />The ditch front slope shalt be no greater than 4:1. <br />5. Slopes shall not be greater than 2:1 For cuts and fills less than <br />or equal to six (6) feet and no greater than 11:1 for curs and <br />fills greater than six (6) feet, unless approved by the Planning <br />Board. <br />6. The maximum grade of the travel way shall be ten (10) percent, <br />however, when the developer furnishes a slope analysis that shows <br />that the area--has a-slope of fifteen (15) percent or greater, the <br />maximum slope may be incressod but not greater than fifteen (15) <br />percent. In areas where this category of roads cannot be constructed <br />with slopes of fifteen (15) percent or less, paved roads shall be <br />required. Grades at stop intersections shall not be greater than <br />four (4) percent for a distance not less rhan fifty (50) feet <br />-from-The inte[section of centerlines. - <br />
