grv 12 244 <br />BE IT RESOLVED: <br />That the County officers are authorized and <br />directed to enter into an agreement or agreements <br />with FLOYD BROWNE ASSOCIATES and/or SOUTHERN <br />NATIONAL BANK when jointly or severally which will <br />provide as follows: <br />a. That in the event FLOYD BROWNE ASSOCIATES <br />should default in its agreement with LEE' COUNTY <br />dated June 1, 1987 or should abandon or cease to <br />operate said water plant then the county shall have <br />the right to enter and operate said plant to ensure <br />continuous operation and this shall be in addition <br />to any other remedies set out in said agreement or <br />provided by law or equity for such breach. <br />b. That in the event SOUTHERN NATIONAL BANK should <br />inititate foreclosure proceedings and/or should <br />acquire FLOYD BROWNE ASSOCIATES interest in said <br />lease and propety then the County agrees to bargain <br />in good faith with SOUTHERN NATIONAL BANK to <br />operate said plant over the remaining period of <br />said leasehold. <br />2. This resolution shall be effective upon adoption. <br />
