Fbw V „u 343 <br />County Attorney K. R. Hoyle appeared before the Board and presented <br />a letter with respect to the Engineering Contract on Project 87-C-0864 in which <br />he recommended that the Board take action to exempt this project from the provisions <br />of Chapter 102 of the Session Laws of 1987, pertaining to procurement of engineering <br />services by a local government. Commissioner Raymond C. Cox, Jr, moved the <br />adoption of the following Resolution: <br />WHEREAS, Lee County, through its Grants Administration Department <br />initiated procedures to solicit bids from qualified firms for the furnishing of <br />engineering services in connection with Project No. 87-C-0864, known as the <br />Golden Poultry/Water Plant Project prior to April 3, 1987; and <br />WHEREAS, such bids were used by the County in preparing and submitting <br />its grant application; and <br />WHEREAS, the firm submitting the lowest bid was selected and contract <br />executed; and <br />WHEREAS, at the same time that the County was following the procedure <br />set forth above, the General Assembly of North Carolina was considering and <br />adopting on April 27, 1987, an act to provide a model code for procurement of <br />engineering services by local governments, which act was not widely dis- <br />seminated and was not known to the County officials involved at the time in <br />said negotiations; and <br />WHEREAS, the act provides that local government units may in <br />writing exempt particular projects which in their discretion merit exemption; and <br />WHEREAS, the Board of Commissioners is of the opinion that this <br />particular project should be exempted because the County has followed the <br />philosophy and intent of said act but that confusion may result because of the <br />date of the contract and the date of the ratification of said act; <br />NOW, THEREFORE, BE IT RESOLVED by the Lee County Board of <br />Commissioners, Project No. 87-C-0864 known as the Golden Poultry/Water <br />Project is exempted from the provisions of House Bill #277 enacted for the <br />procurement of architectural and engineering services by State and local <br />government and Chapter 102 of the Session Laws of 1987 for the reasons <br />stated above. <br />Commissioner Bertha L. Matthews seconded the motion and upon a vote <br />the results were as follows: <br />AYE: Cox, Dossenbach, Matthews and Dotterer <br />NAY: Wicker <br />The Chairman ruled that the Resolution had been adopted by a majority <br />vote. <br />
