Lee County Board ommissioners <br />o:x 42 352 <br />Commissioner Gordon A. Wicker made a motion to adopt <br />said Resolution. Commissioner Bertha L. Matthews seconded <br />the motion, and upon a vote, the results were as follows: <br />AYE: Dossenbach, Matthews, Wicker, and Dotterer <br />NAY: None <br />The Chairman ruled that the Resolution had been adopted <br />by unanimous vote. <br />Mr. Elwin Buchanan, Grants Administrator, presented a <br />revised schedule of grievance procedures relating to <br />relocation claims, payment, and replacement housing, as <br />required in a Community Development Block Grant Project. <br />These procedures are as follows: <br />(1) All material upon which the Department based its <br />original determination including all applicable rules and <br />regulations; <br />(2) The reasons given by the claimant for requesting <br />review and reconsideration of his claim; <br />(3) Whatever additional material has been submitted by <br />the claimant; and <br />(4) Any further information which the Director may, in <br />his discretion, obtain by request, investigation, or research <br />to insure fair and full review of the claim. <br />The final determination or review by the Community <br />Development Department shall include, but is not limited to: <br />(1) The Director's decision on reconsideration of the <br />claim; <br />(2) The factual and legal basis upon which the decision <br />is based, including any pertinent explanation or rationale; <br />(3) A statement of claimant's right to seek within 30 <br />days further review of his claim by HUD and an explanation of <br />the steps the claimant must take to obtain this review, <br />including the address of the HUD Area Office which has respon- <br />sibility for the locality wherein the displacement occurred. <br />Commissioner John R. Dossenbach, Jr. made a motion to <br />accept these procedures. Commissioner Bertha L. Matthews <br />seconded the motion, and upon a vote, the results were as <br />follows: <br />AYE: Dossenbach, Matthews, Wicker, and Dotterer <br />NAY: None <br />The Chairman ruled that the grievance procedures had <br />been approved by unanimous vote. <br />
