&K 12 506 (9) Failure to__Comoly w~tYSS~ If the owner of a building or property fails to comply with an order to take corrective action from which no appeal has been taken, or fails to comply with an order of the governing body following an appeal, he shall be guilty of a misdemeanor and shall be punished in the discretion of the court. SECTION D. ysa_ri_anc_e_ o c e d u r e s (1) The Lee County Planning Board as established by Lee County shall hear and decide appeals and requests for variances from the requirements of this ordinance. (2) Any person aggrieved by the decision of the Planning Board or any taxpayer may appeal such decision to the Court, as provided in Chapter 7A of the NC General Statutes. (3) Variances may be issued for the reconstruction, rehabi- litation or restoration of structures listed on the National Register of Historic Places or the State Inventory of Historic Places without regard to the procedures set forth in the remainder of this section. (4) In passing upon such applications, the Lee County Plan- ning Board shall consider all technical evaluations, all relevant factors, all standards specified in other sections of this ordinance, and: (a) the danger that materials may be swept onto other lands to the injury of others; (b) the danger to life and property due to flooding or erosion damage; (c) the susceptibility of the proposed facility and its contents to flood damage and the effect of such damage on the individual owner; (d) the importance of the services provided by the proposed facility to the community; (e) the necessity to the facility of a waterfront location, where applicable; (f) the availability of alternative locations, not subject to flooding or erosion damage, for the proposed use; (g) the compatability of the proposed use with existing and anticipated development; (h) the relationship of the proposed use to the compre- hensive plan and flood plain management program for that area; -12-
