&K 12 506 <br />(9) Failure to__Comoly w~tYSS~ If the owner of a <br />building or property fails to comply with an order to take <br />corrective action from which no appeal has been taken, or <br />fails to comply with an order of the governing body following <br />an appeal, he shall be guilty of a misdemeanor and shall be <br />punished in the discretion of the court. <br />SECTION D. ysa_ri_anc_e_ o c e d u r e s <br />(1) The Lee County Planning Board as established by Lee <br />County shall hear and decide appeals and requests for <br />variances from the requirements of this ordinance. <br />(2) Any person aggrieved by the decision of the Planning <br />Board or any taxpayer may appeal such decision to the Court, <br />as provided in Chapter 7A of the NC General Statutes. <br />(3) Variances may be issued for the reconstruction, rehabi- <br />litation or restoration of structures listed on the National <br />Register of Historic Places or the State Inventory of <br />Historic Places without regard to the procedures set forth in <br />the remainder of this section. <br />(4) In passing upon such applications, the Lee County Plan- <br />ning Board shall consider all technical evaluations, all <br />relevant factors, all standards specified in other sections <br />of this ordinance, and: <br />(a) the danger that materials may be swept onto other <br />lands to the injury of others; <br />(b) the danger to life and property due to flooding or <br />erosion damage; <br />(c) the susceptibility of the proposed facility and its <br />contents to flood damage and the effect of such <br />damage on the individual owner; <br />(d) the importance of the services provided by the <br />proposed facility to the community; <br />(e) the necessity to the facility of a waterfront <br />location, where applicable; <br />(f) the availability of alternative locations, not <br />subject to flooding or erosion damage, for the <br />proposed use; <br />(g) the compatability of the proposed use with existing <br />and anticipated development; <br />(h) the relationship of the proposed use to the compre- <br />hensive plan and flood plain management program for <br />that area; <br />-12- <br />
