<br />WHEREAS, the County of Lee, acting pursuant to General Statute 158-7. 1,
<br />acquired by gift from Golden Poultry, Inc. , a 10. 066 acre tract of land in fee
<br />simple for the purpose of providing a utility service, namely, water to its
<br />industrial site; and
<br />WHEREAS, the County of Lee is authorized to provide for and assist
<br />in the extension of utility services to industrial sites and to lease interests
<br />in real property held for such purpose by General Statutes 158-7. 1; and
<br />WHEREAS, the Board of Commissioners has determined that the value
<br />of the interest to be leased is $12, 672. 00 and the proposed consideration is $1. 00
<br />per month, together with the acquisition of all improvements at the end of the
<br />lease which improvements are estimated to be worth $2, 000, 000. 00; and
<br />WHEREAS, public notice of a public hearing on both the leasing of said
<br />site and the contracting for the utility sere-ice was published at least ten days
<br />before the hearing was held; and
<br />WHEREAS, the public hearing was held on October 3, 1988, at which time
<br />all interested parties were given the opportunity to express their views on said
<br />matters; and
<br />WHEREAS, the Board of Commissioners, in its discretion, has determined
<br />that the aiding ane encouraging the location of the Golden Poultry industrial plant
<br />near Cumnock will increase the population, taxable property, agricultural interests
<br />and business prospects of Lee County;
<br />NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioner -s
<br />for Lee County as follows:
<br />1. The lease of the real property, which was acquired by gift for the
<br />purpose of providing for utility services to an industrial facility, to Floyd
<br />Browne Associates, Inc., together with easements providing access to such site
<br />is Hereby approved. The interest to be leased is the fee simple interest toget_--er
<br />with the appurtenant easement for access in the following described real property:
<br />ALL THAT CERTAIN TRACT OF LAND, containing 10.066 acres, more or less,
<br />being a part of what was known as the "Zimmerman Farm" near the Village of
<br />Cumnock, West Sanford Township, Lee County, North Carolina, approximately
<br />eight miles northwesterly from the city limits of the City of Sanford and lying
<br />easterly from the terminus of Secondary Road No. 1401 and bounded now or formerly
<br />as follows: North, East and South by the lands of Golden Poultry Company, Inc. ,
<br />(formerly FCX, Inc. ) and West by the lands of T. G. Proctor, Jr. , (formerly
<br />Upchurch and Cooper); said tract of land being more particularly described according
<br />to a plat prepared by Ragsdale Consultants, P. A. , on February 3, 1988, Rey-sed,
<br />May 20, 1988, as follows:
