LEE COUNTY <br /> Committed Today for a Better Tomorrow <br /> RESOLUTION REQUESTING LEGISLATION EXEMPTING LEE COUNTY <br /> FROM MOTOR VEHICLE EMISSIONS INSPECTIONS <br /> WHEREAS, North Carolina General Statute § 143-215.107(a)(6) provides for the adoption of <br /> motor vehicle emissions standards and "when necessary and practicable, a motor vehicle emissions <br /> inspection and maintenance program to improve ambient air quality..."; and <br /> WHEREAS, Session Law 2017-10 (also referred to as Senate Bill 131) removed 26 North <br /> Carolina Counties from the requirement for vehicle emissions inspections; and <br /> WHEREAS, the Environmental Protection Agency approved North Carolina's revision of its air <br /> quality plan on September 25, 2018; and <br /> WHEREAS, According to the Federal Register, Vol. 83, No. 186 Pages 48383-48384, the State <br /> has provided information to the Environmental Protection Agency showing that removing the 26 <br /> counties from the inspections and maintenance requirements will not interfere with the State's <br /> attainment or maintenance of any National Ambient Air Quality Standards or any other requirements <br /> provided in the Clean Air Act; and <br /> WHEREAS, Lee County is not believed to have been previously included for consideration in <br /> exempting from the emissions requirement; and <br /> WHEREAS, Counties surrounding Lee County including Chatham, Harnett, and Moore have <br /> been exempted under the recent legislation; and <br /> WHEREAS, the exemption of Lee County would save residents the time and costs associated <br /> with emissions inspection requirements, <br /> NOW, THEREFORE, BE IT RESOLVED by the Lee County Board of County Commissioners <br /> that: <br /> 1. The Lee County Board of County Commissioners requests that Lee County also be <br /> exempted from emissions inspection requirements. <br /> 2. The State along with the Environmental Protection Agency will consider evaluating Lee <br /> County's compliance with air quality standards per EPA Guidelines. <br /> 3. The County Clerk is directed to forward copies of this resolution to the Executive Director <br /> of the North Carolina Association of County Commissioners, the North Carolina <br /> Department of Environmental Quality's Air Quality Division, Senator Jim Burgin, and <br /> Representatives Robert Reives, II and John Sauls. <br /> Adopted this 18th day of March, 2019. <br /> Amy M.
