GGG <br />STAFF REPORT SUBMITTED AT THE OCTOBER 17TH, 2011 PUBLIC HEARING <br />APPLICANT & OWNER: Village of Cumnock LLC <br />REQUEST: Rezone from Residential Agricultural (RA) and Residential Restricted (RR) district to the <br />Village of Cumnock LLC Highway Commercial Conditional Zoning District <br />LOCATION: Northwest corner of US Highway 421 N and Cumnock Road, SR 1400 <br />TOWNSHIP & FIRE DISTRICT: West Sanford TAX PARCEL: 9625 -63 -6695 <br />ADJACENT ZONING: Residential Agricultural (RA) and Residential Restricted (RR) <br />Site and Area Description <br />The area requested for rezoning consists of 128.84 -acres of land that is situated east of the Deep <br />River which borders Chatham County, north of US Highway 421 N and west of Cumnock Road. <br />The tract has over 2,000 feet of road frontage on Highway 421N and over 800 feet of frontage on <br />Cumnock Road and is currently vacant. The site will be accessed from Cumnock Road due to <br />US Highway 421N being a full controlled access highway. <br />Existing Zoning and Land Use <br />Zoning surrounding the site is Residential Agricultural (RA) and Residential Restricted (RR) <br />district. Across the Deep River in Chatham County the area within 150OLF of US Highway 421 <br />is zoned Residential Agricultural RA -1 with the remainder being un- zoned. The primary land <br />uses in the area are low- density single family dwellings and undeveloped land. The land <br />immediately north of the subject tract is owned by the applicant and is currently vacant. The <br />applicant also owns two other tracts (200 ± - acres) east of Cumnock Road and north and south of <br />Cotten Road. South of the tract and being south of US Highway 421N is an undeveloped 640± <br />acre tract of land. <br />Staff Analysis <br />To date, most of the land in the vicinity of the rezoning remains undeveloped with low- density <br />residential lots. However, the property requested for rezoning is located adjacent to a major <br />highway corridor and thoroughfare. The 2020 Land Use Plan shows the area at the intersection <br />of US Hwy 421 and Cumnock Road within a Highway node which allows for retail and <br />commercial uses. Sanitary sewer lines are located east of the site along Big Buffalo Creek. <br />These attributes supports the development of non - residential properties. <br />The Residential Agricultural (RA) and Residential Restricted (RR) districts are intended for low - <br />density residential and agricultural uses. The dimensional standards include a minimum lot size <br />of 40,000 sq. ft. in the RA district and 30,000 sq. ft. in the RR district. The minimum building <br />setbacks in the RA and RR district is 30ft. front yard, 30ft. rear yard and 1511. side yards. <br />The applicant is requesting to rezone the property to the Village of Cumnock, LLC Highway Commercial <br />Conditional Zoning District (Type 2). The Highway Commercial (HC) district is established to <br />accommodate uses that depend upon a large flow of traffic and convenient access, such as the <br />retailing of merchandise and professional and business services. The HC district requires a <br />minimum building setback of 10 fl. from a public street right -of -way, 0 feet from a rear property <br />line and 0 ft. from all side property lines. As proposed, the development of the property will be <br />subject to the dimensional and density regulations of the Highway Commercial district. <br />
